Civil Aviation (Buildings Control) Regulations 2(Amendment)

I, THE GOVERNOR‑GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Civil Aviation Act 1988.

1.   Amendment

1.1   The Civil Aviation (Buildings Control) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal:  see Acts Interpretation Act 1901, s. 48]

2.   Regulation 2 (Interpretation)

2.1   Insert the following definition:

“‘authorised person’ means a person authorised in writing by the Authority for the purposes of the provision in which the expression occurs;”.

3.   Regulation 7 (Application for approval)

3.1   Subregulation 7 (1):

Omit “a person authorised in writing by the Authority for the purposes of this regulation”, substitute “an authorised person”.

3.2   Subregulation 7 (3):

After “Authority”, insert “or an authorised person”.

4.   Regulation 8 (Grant or refusal of approval)

4.1   Subregulation 8 (1):

Omit “a person authorised in writing by the Authority for the purposes of this regulation”, substitute “an authorised person”.

4.2   Subregulation 8 (2):

After “Authority”, insert “or an authorised person”.

4.3   Subregulation 8 (3):

After “Authority”, insert “or an authorised person”.

4.4   Subregulation 8 (4):

After “The Authority”, insert “or an authorised person”.

4.5   Subregulation 8 (4):

After “unless the Authority”, insert “or the authorised person”.

5.   Regulation 9 (Review of decisions)

5.1   Subregulation 9 (2):

After “Authority”, insert “or an authorised person”.

6.   Regulation 15 (Authority and authorised persons to have certain powers)

6.1   Subregulation 15 (1):

Omit “A person authorised in writing by the Authority”, substitute “An authorised person”.

6.2   Subregulation 15 (3):

Omit “A person authorised by the Authority under subregulation (1)”, substitute “An authorised person”.

6.3   Subregulation 15 (5):

Omit “a person authorised under subregulation (1)”, substitute “an authorised person”.
