CaseChat Overview and Summary
The primary issue before the Commission was whether the agreement met the requirements of the Fair Work Act for it to be approved as a workplace agreement. This involved assessing whether the agreement complied with the procedural requirements for its making and whether it contained all the mandatory terms prescribed by the Fair Work Act. The Commission needed to determine whether the agreement was made in good faith and whether it was made after sufficient consultation with the employees.
The Commission found that the agreement was made in accordance with the relevant provisions of the Fair Work Act. It was determined that the agreement was made in good faith and that there had been sufficient consultation with the employees. The Commission further found that the agreement contained all the mandatory terms required by the Fair Work Act. Consequently, the Commission approved the CATCON WEST AUSTRALIA Renewable Energy Civil Construction Workplace Agreement 2017-2020 as a registered agreement.
