An Act to Authorise the Public Hall of the Townsville City Council to be extended. across Flinders Lane. [ASSENTED TO 5TH NOVEMBER, 1925.] Preamble. "lIlTHEREAS the Council of the City of Townsville,. l'l a Local Authority constituted under *" The Local Authorities Act of 1902," is the registered proprietor of allotment 4, section 4A, Flinders Street, within the said city, and has erected thereon a builrnng which has been used for the purposes of a public hall and theatre, and it is the desire of the said Council to remodel the· said building and extend the same so as to increase the accommodation thereof and otherwise provide for the public requirements, but in order so to do it is. necessary that statutory authority should be obtained to construct a portion of the said building above the roadway of a public lane known as Flinders Lane within the said city and to erect and maintain in the said lane certain supporting piers in places abutting upon certain land vested in and under the control of the Townsville Harbour Board and presently used as a timber yard: And whereas the proposal of the said Council can be carried into effect without interference with the public traffic in and along the said lane and without undue obstruction to the land of the said Harbour Board, and it is in the public interest that statutory authority should be given to the said Council to carry the said proposal into effect: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament· assembled, and by the authority of the same, as follows :- Short title. 1. This Act may be cited as "The City of Townsville Public Hall Improvement Act of 1925." Authority to extend 2. (1.) The Council of the City of Townsville is building hereby authorised and empowered in the re-modelling oFvlienrders and extension of the building erected upon allotment 4,. City of Tmpnsville Public Hall Improvement Act. across Flinders Lane within the said city and to place, construct, and maintain in the said lane the necessary supporting piers and other foundational works and materials in accordance with plans and specifications .approved by the said Council: Provided as follows:- (a) The struc(ure over the said lane shall be so built and maintained as always to leave a clear passage in height of at least fifteen feet above the roadway of the said lane; and (b) The supporting piers in the said lane shall be so constructed and maintained as always to leave a clear opening of access of at least fifteen feet between any two adjacent piers to the land of the Townsville Harbour Board whereupon such piers abut. Council or any contractor with the same or any person .acting under the authority of the same for or in respect Df the erecting or maintaining of the said structure or ..any part thereof over, across, or in the said Flinders Lane, or for or in respect of any damages, loss, or expenses occasioned or alleged to be occasioned by reason of such erecting or maintaining, or of any -obstruction or alleged obstruction of the said lane or ·of any land -abutting thereon, or in anywise whatever arising from the erection or maintenance of the said structure or alty part thereof.
