under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is City of Shoalhaven Local Environmental Plan 1985

(Amendment No 201).

2      Aim of plan

This plan aims to provide for the use of Lot 1, DP 1006744, Graham Street, Nowra for the wholesale retail of fruit and vegetables for a maximum period of 10 years, with no further intensification of the current use of the site to be permitted.

3      Land to which plan applies

This plan applies to land situated in the City of Shoalhaven, being Lot 1, DP 1006744, Graham Street, Nowra, as shown edged heavy black on the map marked “City of Shoalhaven Local Environmental Plan 1985 (Amendment No 201)”.

4 Amendment of City of Shoalhaven Local Environmental Plan 1985

City of Shoalhaven Local Environmental Plan 1985 is amended as set out in Schedule 1.

Insert at the end of the Schedule:

Lot 1, DP 1006744, Graham Street, Nowra, as shown edged heavy black on the map marked “City of Shoalhaven Local Environmental Plan 1985 (Amendment No 201)”—sale by wholesale of fruit and vegetables but only if:

(a)	the Council is satisfied that the carrying out of the development will not involve a further intensification of the current use of the site, and
(b)	the use for that purpose is restricted to a period of not more than 10 years from the commencement of the City of Shoalhaven Local Environmental Plan 1985 (Amendment No 201).
