An Act to Enable the Council ol the City of Rockhampton to Purchase for an Estate in Fee-Simple portions of certain Lands now held by that Council in Trust as Reserves respectively for Municipal and School of Arts Purposes. [A ssented to 26 th N ovember , 1959.] B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— Short title 1. This Act may be cited as “ The City of Rockhampton (Lands Purchase) Act of 1959.” Termination of existing 2. As from the commencement and by virtue of trusts. this Act, the freehold lands under “ The Real Property Acts, 1861 to 1956,” described in Part I. of the Schedule to this Act shall be absolutely freed and discharged from the trusts upon and subject to which such lands were theretofore vested in and held by the Council of the City of Rockhampton, and be divested from the said Council, and become and be Crown lands.

The Governor in Council may, in the name Authority of Her Majesty, sell to the Council of the City of purchasof Rockhampton, and the said Council may purchase, for an estate in fee-simple, the lands described in Parts II. and III. of the Schedule to this Act completely freed and discharged from the trusts upon and subject to which those lands were vested in and held by the said Council before the commencement of this Act but, save those trusts, subject to any and every mortgage, charge, encumbrance, lien, lease, easement, agreement, license or other transaction affecting those lands or any portion or parcel thereof. (2.) The purchasing price of the lands the sale and purchase whereof is authorised by subsection one of this section shall be ninety thousand pounds. 4. The Governor in Council, shall, pursuant to the Reserves for provisions of “ The Land Acts, 1910 to 1959,” thereunto ^Sc'wi empowering him,— of Arts purposes. (a) Reserve for Municipal purposes the land described in Part IV. of the Schedule to this Act; and (b) Reserve for School of Arts purposes the land described in Part V. of the Schedule to this Act, and, without issuing any deeds of grant, place under the control of the Council of the City of Rockhampton as trustee those lands as so reserved. • 5. (1.) Subject to the Council of the City of fresh deed* Rockhampton paying the purchasing price of ninety of grant‘ thousand pounds, a sum determined by the Minister for Public Lands and Irrigation in respect of the cost of surveying for the purposes of this Act the lands described in Part I. of the Schedule to this Act, and the appropriate deed and assurance fees, the Goverrior in Council shall issue two deeds of grant comprising respectively— (a) The land described in Part II. of the Schedule to this Act; and (5) The land described in Part III. of the Schedule to this Act. Upon the enrolment of those deeds of grant coefretxifiisctaintegs under the provisions and for the purposes of “ The Real of title. Property Acts, 1861 to 1966,” the Local Deputy Registrar of Titles for the Central District under and within the meaning of “ The Real Property (Local Registries) Act of 1887,” shall cancel Certificates of Title Number C. 29919, Volume 209, Folio 172, Number C. 18362, Volume 156, Folio 115, and Number C. 45486, Volume 274, Folio 239. (3.) The said Local Deputy Registrar of Titles shall endorse upon the deed of grant for the lands described in Part II. of the Schedule to this Act the three leases registered in his registry and numbered respectively C. 134879, C. 185518, and C. 192491. (4.) The said Local Deputy Registrar of Titles shall endorse upon the deed of grant for the lands described in Part III. of the Schedule to this Act the two leases registered in his registry and numbered respectively C. 111721 and C. 191844 and the bill of mortgage of the interest of the lessees in the said lease numbered C. 191844 registered in his registry and numbered C. 191845.
