AN ACT to amend the City of Perth Parking

Facilities Act 1956-1981.

[Assented to 22 November 1982.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the City of Perth argttlieon

Parking Facilities Amendment Act 1982.

(2) In this Act the City of Perth Parking li=edd2Os

Section 11

amended. 2. Section 11. of the principal Act is amended

(a) in subsection (1)-

(i)   in paragraph (j) by deleting "Fund." and substituting the following-

" Fund; " ; and

(ii)   by inserting after paragraph (j) the following paragraph

(k) with the consent of the Minister, permit a commu- nity association to use a parking station or parking facility for the purposes of the community association during such hours and sub- ject to such conditions as the Council may, with the approval of the Minister, specify but such use shall not be permitted at any time when the parking station or parking facility would otherwise be avail- able for the parking of vehicles. " ; and

(b) by inserting after subsection (1) the follow- ing subsection

(la) For the purposes of subsection (1) (k), "community association" means an institution, association, club, society or body, whether incorporated or not, the objects of which are of a charitable, benevolent, religious, cul- tural, educational, recreational, sport- ing or other like nature and the members of which are not entitled or permitted to receive any pecuniary profit from the transactions

thereof. " .
