W HEREAS pursuant to a Resolution passed at a meeting of the Council of the City of Mackay (constituted under *" The Local Authorities Acts, 1902 to 1932 "), holden on the Eighth day of December, One thousand nine hundred and thirty-two, the services of a Town Planner were secured for the purpose of Town Planning the City of Mackay: And whereas the said Town Planner having completed a Civic Survey presented to the said Council his Report and Town Plan for a Town Planning Scheme for the said City: And whereas, pursuant to a Resolution passed at a meeting of the said Council holden on the Fifteenth day of May, One thousand nine hundred and thirty-four, the said Report and Plan was adopted: And whereas the said Council published under the hand of the Town Clerk in the Daily Mercury of the Seventh day of July, One thousand nine hundred and thirty-four, the following notice :-" Notice is hereby given that a Town Planning Scheme for Mackay has been prepared, and the Report and Plans in connection therewith are open to inspection at the Town Hall. Any objection to the Scheme must be lodged with the undersigned, in writing, within a perioU of three months from this date, at the expiration o£ which time the Scheme will be submitted to the Honourable the Home Secretary for approval " : And whereas the provisions of such Town Planning Scheme are more particularly described in Schedule 1. and illustrated by the Town Plan in Schedule n. of this Act: * 2 Edw. And whereas it is desirable that the said Town Planning Scheme for the City of Mackay be approved, authorised, and ratified, and that the several acts afore- said of the Council of the City of Mackay be approved, authorised, and ratified, and that, subject to. any amendments, alterations, additions, or modifications made in such Scheme by the said Council with the approval of the Governor in Council, pursuant to the said notice, such Scheme be approved, authorised, and ratified- Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- PART 1.--PRELIMINARY. PART I.- PRELIMINARY. 1. (1.) This Act may be cited as "The Oity of Short title Mackay and Other Town Planning Schemes Approval :~!truction. Act of 1934." (2.) This Act shall be read as one with and as an amendment of *" The Local Authorities Acts 1902 to 1932," or t" The Health Acts, 1900 to 1931," or any Act amending or in substitution for the same. 2. A Town Planning Scheme may be made by Town. a Local Authority for any defined part or all of the land ~ !~~ ~~; within the Area under its jurisdiction; moreover any such Scheme proposed by all or any of the owners of any land within the jurisdiction of a Local Authority may be adopted by such Local Authority with or without modifications. (2.) When a Local Authority has decided to prepare Resolution or adopt a Town Planning Scheme, it s~ all pass a tufho~r~ ~y. resolution to that effect defining the area it IS proposed to include within the Scheme. Civic survey. 6. Before any Town Planning Scheme is made such Scheme shall be preceded by a survey of the existing conditions in relation to the present and potential uses and values of all lands therein in relation to the local public utilities, services, amenities, and such other matters or things as may be directed by the Minister or as may be prescribed. Objections. 7. (1.) When a Town Planning Scheme has been prepared by a Local Authority, and before it has been forwarded to' the Minister for the approval of the Governor in Council, the Scheme and all plans connected therewith shall be open for inspection at the office of the Local Authority for three months. The Local Authority shall by advertisement in some newspaper circulating in its Area give due notice that the Scheme is open to inspection. (2.) During the time that a Scheme is open to inspection any person affected by the Scheme may forward objections to the Scheme or to any part thereof in writing to the Local Authority together with reasons for such objections. (3.) After the period of inspection all objections so lodged shall be considered by the Local Authority, and the Local Authority shall then forward to the Minister the Scheme together with the objections received, its representations thereon, and a statement regarding the action it proposes to take in the case of each objection. (4.) The Governor in Council may require such amendments, alterations, additions to, or modifications of the Scheme as he may deem fit. Scheme to be 8. A Town Plannmg Scheme may be altered, Alterations, amplified, or revoked by a subsequent Scheme made or &c.• of adopted by the Local Authority and approved by the Scheme. (2.) In addition to any powers conferred on it by the Local Authorities Acts or by any other Act a Local Authority shall, subject to the provisions of section nine hereof, have all such powers and authorities as may be considered necessary to enable it to give full effect to an approved Scheme. (3.) Moreover when any such Scheme has been finally approved by the Governor in Council as aforesaid, and such approval has been published in the Gazette, such Scheme is and shall be deemed to be approved, authorised, and ratified, and shall have the force of law and be obeyed by the Local Authority and all persons concerned, and its legality shall not be questioned in any proceedings in any court whatever. 11. (1.) Any person who is dissatisfied with the Dissatisfied requirements or decisions of a Local Authority acting perso~ may under the powers conferred by a Scheme may within appea . thirty days of being notified thereof by the Local Authority appeal to the Minister in accordance with the provisions hereunder set forth. (2.) No. 19, For the purposes of such appeal the Minister or such person or persons appointed by him shall have all the powers, authorities, and protection of a Commission under *" The Official Inquiries Evidence Acts, 1910 to 1929," and shall determine the matter having regard to this Act, the circumstances of the case, and the public interest_ The decision of the Minister or such person appointed by him as aforesaid upon any such appeal shall have the force of law and shall be final, and shall be binding upon the Local Authority and the appellant, and for the purposes of this Act shall be deemed to be the final decision of the Local Authority_ The costs of such appeal shall be in the discretion of the Minister or such person appointed by him as aforesaid. A Local Authority may for any purpose in a Town Planning Scheme purchase or resume any land comprised in the Scheme whether such land is required for the purpose of the Scheme immediately or not, and for that purpose shall have all the powers and authorities conferred on a Local Authority by t" The Public TV orks Land Resumption Acts, 1906 to 1926" (or any Act amending or in substitution for the same). Any person whose property is injuriously affected by the making of a Town Planning Scheme shall be entitled to obtain Gompensation in respect thereof from the Local Authority, and for that purpose the Local Authority and such persons shall be subject to the provisions of t" The Public TV orks Land Resumption Acts, 1906 to 1926" (or any Act amending or in substitution for the same). (b) Any work done for the purpose of finishing a building completely planned or of carrying out a contract entered into before the date of approval of the resolution. (3.) (1.) (2.) Where such notice has been given, the Local Authority shall within thre~ months from the date of such notice submit for the approval of the Governor in Council a varying Scheme carrying into effect such withdrawal or modification as aforesaid, and upon approval of the varying Scheme, whether with or without modification, and payment by the Local Authority of the owner's costs of and in connection with the fixing of the compensation, the award shall be discharged without prejudice, however, to the right of the owner to make a further claim for cumpensation in respect of the said Scheme as varied. (3.) No award of compensation in respect of property injuriously affected by the making of a Town Planning Scheme shall be enforceable within one month from the date thereof, or, if notice has been given by the Local v

Regulations. 17. The Governor in Council may from time to time make regulations providing for all or any purposes, whether general or to meet particular cases, that may be convenient for the administration of this Part of this Act or that may be necessary or expedient to carry out the objects and purposes of this Part of this Act, and where there may be in this Part of this Act no provision or no sufficient provision in respect of any matter or thing necessary or expedient to give effect to this Part of this Act, providing for and supplying such omission or insufficiency. Without limiting the generality of these provisions such regulations may provide for all or any of the following matters :- (a) The matters to be dealt with in the preparation or adoption of Town Planning Schemes, or in any alteration, amplification, or revocation of any such Scheme by a subsequent Scheme; the civic surveys appertaining thereto; model clauses for the guidance of Local Authorities in preparing such Schemes; the procedure to be followed in obtaining the approval of Town Planning Schemes. (b) The method of considering objections to Town Planning Schemes by Local Authorities; the procedure to be adopted by Local * 15 Geo. V. No. 32 and amending Acts, supra, pages 11140 et seq.

Authorities in submitting such objections PARTIII.- TOWN PLANNING SCHEMES GENERALLY. and their representations thereon to the Minister. (c) Providing for the procedure in respect of appeals and the necessary forms in regard thereto. (d) All forms under this Part of this Act. (e) All matters or things required or permitted by this Part of this Act to be prescribed. All such regulations made or purporting to be made under this Act shall upon being published in the Gazette have the same effect as if they were enacted in this Act and shall be judicially noticed, and shall not be questioned in any proceedings whatsoever. All such regulations shall be laid before Parliament forthwith, if then sitting; and, if not then sitting, within fourteen days after the commencement of the next ensuing session. If the Legislative Assembly, within the next fourteen sitting days after any regulations have been so laid before such House, resolves that such regulations or any of them ought to be annulled, the same shall after the date of such resolution be of no effect, without prejudice to the validity of anything done in the meantime under such regulations or to the making of any new regulations. For the purpose of this section the term" sitting days" shall mean days upon which the House actually sits for the despatch of business. SCHEDULE I. THE CITY OF MACKAY TOWN PLANNING SCHEME. 1. The parts of the City of Mackay herein designated as " Zones" are such as are more particularly set forth in the Table of Zones and delineated on the map hereto.

Those parts of the City of Mackay defined under Zone 1 and shown on the map as Residential Zones are hereby declared to be residential districts. 3. No person shall erect any building for use for the purposes of the various trades, industries, manufactures, shops, and places of amusement described in the Table of Zones hereto, except as defined therein, and such trades, industries, manufactures, shops, and places of amusement are prohibited in the said Zone 1, except in accordance with the provisions hereinafter set forth: Provided that any use that may be allowed in a residential zone, or in any other zone in descending order, from Zone 1 to Zone 6, shall be allowed in a zone of lower order unless otherwise stipulated. 4. The use of any building in the said Zone 1 for any purposes, except in accordance with the provisions of this Schedule, shall be prohibited unless the building was being used for that purpose at the date of this order, in which case the use may be continued: Provided that upon the destruction of any such building or upon the discontinuance for six months, from any cause, of such use the right of continuance shall cease: Provided also, that if, through the expansion of such a use or undertaking, it is desired to rebuild or add to such building, application for permission to rebuild or to make such addition shall be made to the Council. With such application the applicant shall lodge a statement signed by eighty per cent. of the property-owners within a radius of five chains of the existing building in question that they agree to the extension of the undertaking in its present position.• Upon receiving such application and declaration the Council may approve, with or without such conditions as it considers necessary to prevent the undertaking from becoming any greater detriment to the locality than it was at the date of the Order in Council approvmg of the Scheme, or disapprove. 5. No person shall erect, maintain, or use any advertisement hoarding within any part of the City of Mackay classified under Zone 1 as a residential zone. 6. Subject to the other provIsIOns of this Order, no building shall be erected in the said Zone 1 unless it complies with the By-laws of the said Council for the time being in force relating to buildings and land subdivision. 7. The use and occupation of lands and buildings within the City of Mackay shall be limited to the uses set forth in the Table of Zones hereto, wherein the predominant use for which each of the several zones referred to in the first column is intended to be reserved is the use indicated in that column, and the classes of buildings which may be erected, or uses which may be made, with or without the consent of the said Council, or with its consent after advertisement, as the case may be, or may not be erected or used in each zone are as set forth in the second, third, fourth, and fifth columns thereof. In giving consent to the erection of a building or to a use of land being made where such consent is required, as set out in the third and fourth columns of the Table of Zones hereto, the said Council

In giving or withholding its consent or imposing conditions the said Council shall have regard to the likelihood of the building or use of land injuring the amenity of the zone including, in the case of an industrial building, the likelihood of any injury due to the emission of smoke or fumes, dust, noise, or smell, or nther cause. 8. (a) Upon an application being made to the said Council for its consent in any zone to the erection of any building or the making of any use which is shown against that zone in the fourth column of the Table of Zones hereto, the said Council shall give notice of the said application by advertisement, as soon as may be, in a newspaper circulating in the Area. . The said notice shall be at the cost of the applicant, and shall state that any objection to the application, addressed to the said Council in writing within fourteen days of the date of the advertisement, will be considered. (b) The said Council shall take into consideration any objection so received, and shall thereupon decide to give or withhold its consent or to give its consent upon such conditions as it may think fit, and shall forthwith serve a notice of its decision and the reasons therefor upon the applicant and upon any person objecting under paragraph (a) of this clause. (c) A decision of the said Council under this clause shall not take effect until the expiration of twenty-one days from the date upon which the applicant and the objectors (if any) are notified of the decision. 9. The said Council may from time to time vary or add to the uses that may be made of or buildings which may be erected in any zone, or the use that may be made of or building that may be erected in any zone, or the uses that may not be made of or the buildings which may not be erected in any zone in the Table of Zones hereto. Notice of motion concerning any such proposed alteration or addition shall be given one month before it is dealt with by the Council, and at the time it is given the notice of motion shall be advertised in a local newspaper stating the date upon which the proposal will come before the Council, and that objections thereto may be lodged with the Council in writing before that date. Before any such alteration takes effect it must be approved by the Governor in Council and published in the Gazette. 10. If at any time the said Council is of the opinion that any part of the Table of Zones, or the boundaries of the zones delineated on the map hereto should be varied or added to, it shall give three months' notice by advertisement in a local newspaper of its intention, stating that particulars regarding the proposed alteration are available at the Town Hall and that objections, in writing, forwarded to the Council during the said period of three months will be considered. If at the end of the said period the Council, having considered the objections (if any), decides to proceed with the alteration it shall be forwarded, with copies of any objections received, to the Minister. Such alteration shall not take effect until it has received the approval of the Governor in Council and has been publi!:lhed in the Gazette. 15191 I

For the purposes of this table the descriptions "Home Industries," "Domestic Industries," "Light Industries," "Heavy Industries," and "Isolated Industries " shall include the industries set out under each description hereunder respectively; and the description "Shops" shall include the shops or rooms described thereunder; and the description "Places of Assembly and Amusement" shall include the places of assembly and amusement described thereunder, that is to say,- HOME INDUSTRIES. (Not requiring the use of a separate building).
