755 (Ilix mlslml^ 61 L- - 1 , 4 V, ANNO VICESIMO SEPTIMO ELIZABETHAE SECUNDAE REGINAE No. 88 of 1978 An Act to amend The City of Brisbane (Water Supply) Act of 1959 and the Somerset Dam Catchment AreaDeclaratoryAct 1974 each in certain particulars and for other purposes [ASSENTED TO 15TH DECEMBER, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the City of Brisbane (Water Supply) Act and Another Act Amendment Act 1978. 2. Arrangement of Act. This Act is divided into Parts as follows:- PART I-PRELIMINARY (SS. 1-2): PART If-AMENDMENT OF CITY OF BRISBANE (WATER SUPPLY) ACT (ss. 3-4); PART Ill-AMENDMENT OF SOMERSET DAM CATCHMENT AREA DECLARATORY ACT (ss. 5-7): PART IV-ALTERATION OF CERTAIN VALUATIONS (S. 8).
756 City of Brisbane (Water Supply) Act and Another Act Amdt Act 1978, No. 88 PART 11-AMENDMENT OF CITY OF BRISBANE (WATER SUPPLY) ACT 3. Citation . (1) In this Part the City of Brisbane (Water Supply) Act of 1959 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the City of Brisbane (Water Supply) Act 1959-1978. 4. Amendment of s. 12. Section 12 of the Principal Act is amended by- (a) numbering the existing provisions as subsection (1); (b) adding at the end thereof the following subsection:- " (2) Notwithstanding the provisions of the Valuation of LandAct1944-1977 or any rule of practice, in ascertaining the unimproved value of any land described in the First Schedule to this Act the Valuer-General shall not have regard to the fact or extent of inundation of such land by the waters of Somerset Dam, but otherwise the provisions of that Act shall apply. This subsection shall be deemed to have been enacted on 31 March 1963.". PART III-AMENDMENT OF SOMERSET DAM CATCHMENT AREA DECLARATORY ACT 5. Citation . (1) In this Part the Somerset Dana Catchment Area Declaratory Act 1974 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Somerset Dam Catchment Area Declaratory Act1974-1978. 6. Amendment of s. 9. Section 9 of the Principal Act is amended by omitting from subsection (1) the words " Valuation of Land Act1944-1974, which is, pursuant to that Act," and substituting the words " Valuation of Land Act1944-1977 and in accordance with section 12 (2) of the City of Brisbane (Water Supply) Act 1959-1978, which is, pursuant to the former Act,". 7. Amendment of s. 10 . Section 10 of the Principal Act is amended by omitting from subsection (1) the words " Valuation of Land Act1944-1974 " and substituting the words " Valuation of Land Act1944-1977 and in accordance with section 12 (2) of the Citr of Brisha::c (Water Suppy) Act 1959-1978 ". PART IV-ALTERATION OF CERTAIN VALUATIONS 8. Valuer-General ' s authority to alter valuations . Where at any time before the passing of this Act a valuation has been made of a parcel of land being part of the Somerset Dam Catchment Area within the meaning of the Somerset Dam Catchment Area Declaratory Act1974-1978, which valuation was made, in relation to any part of that parcel that was inundated at the time it was made, otherwise than in accordance with section 12 (2) of the City of Brisbane (Water Supply) Act 1959-1978, the Valuer-General is hereby authorized to take all steps necessary to alter the valuation so made and to notify the owner of that parcel and the
City of Brisbane (Water Supply) Act and Another Act Amdt Act 1978, No. 88 757 Local Authority in whose Area that parcel is situated and the valuation as so altered shall be deemed to be the unimproved value of that parcel as from the date on which the valuation that is altered had taken effect. Notwithstanding the provisions of any other Act the unimproved value notified pursuant to this section shall not be the subject of any objection or appeal.
