1490 Citt, of Brisbane (I ariation of Refuse Contracts) Act 1985, No. 96 BE IT ENACTED by the Queen ' s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as the Citr of Brisbane (i'ariation of Refuse Contracts) Act 1985. 2. Interpretation . In this Act. unless the contrary intention appears- "Council" means Brisbane City Council; "contract to which this Act applies" means- (a) the contract entered into between the Council and Waste Management Queensland Pty. Ltd. dated 22 May. 1984 relating to removal and transport of refuse which had effect on and from 29 June. 1984; (b) the contract entered into between the Council and Hunter Bros. (Qld.) Pty. Ltd. dated 21 June, 1984 relating to removal and transport of refuse which had effect on and from 29 June, 1984; or (c) the contract entered into between the Council and Thiess Contractors Pty. Ltd. dated 22 May, 1984 relating to the management of refuse disposal places and facilities which had effect on and from 29 June, 1984; "other party to the contract" means- (a) in the case of the contract to which this Act applies between the Council and Waste Management Queensland Pty. Ltd., Waste Management Queensland Pty. Ltd.; (b) in the case of the contract to which this .Act applies between the Council and Hunter Bros. (Qld.) Pty. Ltd., Hunter Bros. (Qld.) Pty. Ltd.; or (c) in the case of the contract to which this Act applies between the Council and Thiess Contractors Pty. Ltd., Thiess Contractors Pty. Ltd.; "vary", in relation to a contract to which this Act applies, includes the substitution for that contract of another contract. 3. Variation of refuse contracts . Where, in respect of a contract to which this Act applies, the Council and the other party to the contract- (a) have, by agreement in writing, varied or purported to vary the contract; or (b) agree. in writing, to vary the contract, any such variation. purported variation or agreement to vary,
City of Brisbane (Variation of Refuse Contracts ) Act 1985, No. 96 1491 notwithstanding anything to the contrary contained in the Local Government Act 1936-1985 or any Ordinance of the Council, shall- (i) be deemed to have been validly made; (ii) take effect according to its tenor; (iii) be deemed to have had or, as the case may be, shall have full force and effect, as between the Council and the other party to the contract from the date specified in the agreement as the date on and from which it shall have effect.
