City of Brisbane (Transitional) Amendment Regulation (No. 1) 2010 [s 1] 1 Short title This regulation may be cited as the City of Brisbane (Transitional) Amendment Regulation (No. 1) 2010 . 2 Commencement This regulation is taken to have commenced on 1 July 2010. 3 Regulation amended This regulation amends the CityofBrisbane(Transitional)Regulation 2010. 4 Insertion of new s 3A After section 3— insert— ‘3A Transitional provisions for by-elections ‘(1) Despite the repeal of the CityofBrisbaneAct1924 , the election provisions of that Act continue to apply to by-elections for the council— (a) as if a reference in the provisions to the town clerk were a reference to the chief executive officer; and (b) with other necessary changes. ‘(2) The election provisions , of the repealed City of Brisbane Act, are— (a) part 2, divisions 3 and 5; and (b) any provisions of schedule 2 that are relevant to the provisions mentioned in paragraph (a). ‘(3) Despite the repeal of the LocalGovernmentAct1993 , the provisions of that Act in force on 30 June 2010 as they applied to the Brisbane City Council on that day continue to apply to by-elections for the council— (a) as if a reference in the provisions to a division of a local government area were a reference to a ward; and Page 2 2010 SL No. 250
