City of Brisbane Town Planning Act Amendment Act 1986, No. 18 175 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the City of Brisbane Town Planning Act Amendment Act 1986. (2) In this Act the City of Brisbane Town Planning Act 1964-1985 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the City of Brisbane Town Planning Act 1964-1986. 2. Commencement . (1) This Act other than section 3 (b) shall commence on the day on which it is assented to for and on behalf of Her Majesty. (2) Section 3 (b) of this Act shall commence on a day appointed by Proclamation. 3. Amendment of s. 3 . Definitions . Section 3 of the Principal Act is amended by- (a) omitting the definition "Authorised surveyor"; (b) omitting the definition "Delegate" and substituting the following definition:- " "Delegate"-a delegate pursuant to a delegation -made under the City of Brisbane Act 1924-1986;';• (c) in the definition "Minister" omitting the words "and Conservation of Queensland" and substituting the words ", Main Roads and Racing". 4. Amendment of s. 4 . Town Plan for the City of Brisbane . Section 4 of the Principal Act is amended by- (a) in subsection (5)- (i) omitting all words from and including "and a set" to and including "and the proposed new Plan"; (ii) adding to the end thereof the following paragraph:- "Notwithstanding the provisions of section 3B, the premises known as the School of Arts building situated at Ann Street in the City of Brisbane shall be the prescribed place for the public exhibition of the proposed new Plan exhibited under this section next following the commencement of section 4 (a) of the City of Brisbane Town Planning Act Amendment Act 1986."; (b) in subsection (12) inserting after the words "consider and" the words ", by resolution,". 5. Amendment of s. 5. Brisbane City Council to administer the Plan. Section 5 of the Principal Act is amended by omitting the expression "(I)".

176 City of Brisbane Town Planning Act Amendment Act 1986, No. 18 6. Amendment of s. 6 . Brisbane City Council may propose amendments of Town Plan. Section 6 of the Principal Act is amended by- (a) in subsection (1), inserting after the words "Brisbane City Council" occurring in the first paragraph, the words "pursuant to a resolution"; (b) in subsection (9), inserting after the words "consider and" the words ", by resolution,". 7. Amendment of s. 8. Application for rezoning of land . Section 8 of the Principal Act is amended by, in subsection (4), inserting after the words "section, the Council" the words ", by resolution,". 8. Amendment of s. 12. Town planning certificate . Section 12 of the Principal Act is amended by, in the paragraph commencing with the words "Every such certificate", adding at the end thereof the words "or resolution of the Council". 9. Amendment of s. 16 . Assessment of compensation . Section 16 of the Principal Act is amended by, in subsection (2), inserting after the words "at its option" the words ", pursuant to a resolution,". 10. Amendment of s. 22B. Applications and appeals concerning superseded town plans , etc. Section 22B of the Principal Act is amended by, in subsection (5), omitting the words "or its delegate" wherever they occur.
