823 ANNO UNDECIMO ELIZABETHAE SECUNDAE REGINAE •••••••••••••••••••••••• t •••••••••••••••••••••••••• No. 17 An Act to Extend the Period during which Brisbane City Council shall keep Open for Inspection the Town Plan for the City of Brisbane prepared by The Greater Brisbane Town Planning Committee, and the report of such Committee thereon [AsSENTED TO 29TH MARCH, 1962] B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- !. (1) This Act may be cited as "The City ofShort title Brisbane Town Plan (Extension of the Period for Inspection) Act of 1962." (2 ) This Act shall be read as one with " The City tl a nt 1 t~ 0 r n pre- of Brisbane (Town Plan) Act of 1959," as heretofore amended.
824 City of Brisbane Town Plan, Etc., Act 11 ELIZ. II. No. 17, Extension of period for inspection 2. (1) The period for which the Council has, pursuant to section seven of " The City of Brisbane (Town Plan) Act of 1959," as heretofore amended, opened and kept open to inspection at its office the Plan and the report of the Committee thereon (or true copies thereof respectively) shall be, and notwithstanding that such period has expired, is hereby extended for a period of ninety days from and including the date of the passing of this Act. (2) Forthwith after the date of the passing of this Act, the Council shall, by advertisement published at least once in at least one newspaper printed and circulated in the City of Brisbane, give public notice that the Plan and aforementioned report (or true copies thereof respectively) will continue to be open to inspection during the extended period prescribed by this Act (specifying such period) and that, during such extended period, objections may be lodged in the form and manner prescribed by "The City of Brisbane (Town Plan) Act of 1959." (3) For the purposes of " The City of Brisbane (Town Plan) Act of 1959," the extended period prescribed by this Act shall be included in and be part of the period during which the Plan and report of the Committee thereon (or true copies thereof respectively) are opened and kept open to inspection by the Council at its office pursuant to the provisions of such Act. (4) (a) Subject to this subsection the Council may open and keep open to inspection at a place other than its office the Plan and the report of the Committee thereon (or true copies thereof respectively) during the whole or part of the extended period prescribed by this Act. Such place shall be a place, distant not more than one-half mile from the office of the Council, which in the opinion of the Council is centrally and conveniently situated.
1962 City of Brisbane Town Plan, Etc., Act (b) If the Council desires to open and keep open the Plan and the report of the Committee thereon (or true copies thereof respectively) at a place other than its offi.ce- (i) for the whole of the period prescribed by this Act, the Council shall, in the advertisement published under subsection (2) of this section, state that fact and the address of such other place ; or (ii) for part of the period prescribed by this Act, the Council before so doing shall, by advertisement published at least once in at least one newspaper printed and circulated in the City of Brisbane, give public notice of that fact and of the address of such other place. (c) At any time during the extended period prescribed by this Act when the Plan and the report of the Committee thereon (or true copies thereof respectively) are opened and kept open for inspection at a place other than the office of the Council in respect whereof the Council has complied with the requirements of this subsection, the same shall be deemed to be opened and kept open for inspection in compliance in every respect with the requirements of" The City of Brisbane (Town Plan) Act of 1959," as heretofore amended, and this Act. 825 3. Until the Plan (being approved by the Governor Addi!ional in Council) shall become and be the Town Plan for the ;TI~;on City of Brisbane and have the force of law, the Committee Committee shall continue in existence and be charged with the additional function of advising Brisbane City Council and any delegate thereof on matters concerning the use and development, and the regulation and control of the use and development, of land in the City of Brisbane or in any part thereof.

No. 17, 1962 Brisbane City Council or any delegate thereof shall, in determining any such matter, have such regard as it or he thinks fit to the advice thereon of the Committee. The provisions of" The City of Brisbane (Town Plan) Act of 1959," as heretofore amended, and in particular the provisions of sections four, five, ten and eleven thereof shall, with and subject to any necessary modifications, apply for the purposes of this section and the staff, including the secretary to the Committee, appointed under section ten thereof and employed at the date of the enactment of this section may be continued in their respective employments for the purposes of the exercise by the Committee of its additional function under this section until the Council, upon the recommendation of the Committee, otherwise determines.
