237 1K u tt5fitxTi^ ANNO QUINTO DECIMO ELIZABET HAE SECUNDAE REGINAE No. 31 of 1966 An Act to Amend "The City of Brisbane Acts, 1924 to 1960," in certain particulars [ ASSENTED TO 21ST DECEMBER, 1966] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The City of Brisbane Acts Amendment Act of 1966." (2) Principal Act. " The City of Brisbane Acts, 1924 to 1960," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The City of Brisbane Acts. 1924 to 1966."

Section forty-four of the Principal Act is amended by, in the last proviso appearing therein- (a) omitting the words " by ordinance " and inserting in their stead the words " by resolution "; and (b) omitting the words " five pounds per centum " and inserting in their stead the words " six per centum ". 3. Repeal of E. 55 and enactment of new s. 55, s. 56. The Principal Act is amended by repealing section fifty-five and inserting in its stead the following sections :- " [55.] Quinquennial Reprint of Ordinances, &c. The Council shall on such date as is prescribed by the Governor in Council by Order in Council and once at least in every period of five years thereafter publish in such form and in such manner as the Council determines a reprint (in this section referred to as " the reprint ") of- (a) this Act and every amendment thereof for the time being in force; (b) all ordinances for the time being in force; (c) such Proclamations, Orders in Council rules and directions made under this Act as the Governor in Council by Order in Council from time to time determines; (d) such Acts, or such specified parts of such other Acts, as the Governor in Council by Order in Council from time to time determines; and (e) such Proclamations, Orders in Council, regulations, rules and by-laws or such specified parts of such other Proclamations, Orders in Council, regulations, rules and by-laws as the Governor in Council by Order in Council from time to time determines. Each volume of the reprint shall contain a certificate by the Mayor_ that the volume correctly expresses and sets forth the material contained therein as at the date stated in the certificate. Upon payment by any person of such amount as is determined by the Council by resolution in relation to such volume the Council shall supply to that person a copy of any volume of the reprint.

City of Brisbane Acts Amendment Act of 1966, No. 31 239 [56.] Publication of Proclamations and Orders in Council . (1) Every Proclamation, Order in Council, rule and direction made under this Act shall- (a) be published in the Gazette; (b) upon its publication in the Gazette, be judicially noticed and such publication shall be conclusive evidence of the matters contained therein; (c) take effect on and from the date of such publication, unless in the case of any such Order in Council, rule or direction a later date is specified in that or any other such Order in Council, rule or direction for its commencement when in such event it shall take effect from that later date; and (d) be laid before the Legislative Assembly within fourteen sitting days after such publication if the Legislative Assembly is in session, and if not, then within fourteen sitting days after the commencement of the next session. (2) If the Legislative Assembly passes a resolution, of which notice has been given at any time within fourteen sitting days after any such Proclamation, Order in Council, rule or direction has been laid before the Legislative Assembly, disallowing such Proclamation, Order in Council, rule or direction or part thereof, that Proclamation, Order in Council, rule or direction or part shall thereupon cease to have effect, but without prejudice to the validity of anything done thereunder in the meantime or to the power to make a new Proclamation, or, as the case may be, Order in Council, rule or direction." 4. Amendments in relation to decimal currency . The Principal Act is amended in accordance with the Schedule to this Act. 5. Ordinance , Chapter 67. (1) It is hereby declared that Chapter sixty-seven of the Ordinances made under The City of Brisbane Acts, 1924 to 1949 " and published in the Government Gazette of the thirteenth day of August, 1949, is and always has been in force on and from that date. (2) Subsection ( 1) of this section shall cease to have any operation on and after the date prescribed by the Governor in Council pursuant to section fifty - five of " The City of Brisbane Acts , 1924 to 1966."
