312 Savings. AGRICULTURE-BRISBANE. City of Brisbane Acts Amendment Act. 14 GEO. VI. No. 19, 16. (1.) The amendments made by this Act to the Principal Act shall not affect the continuity of the identity or, except as hereinafter provided in this section, any rights or obligations of the Corporation established in accordance with the Principal Act, or the tenure of office of any member of that Corporation holding office at the date of the coming into operation of this Act. (2.) As from the coming into operation of this Act there shall be transferred to the Minister of Food for the United Kingdom all rights of the Overseas Food Corporation in respect of advances made by the Overseas Food Corporation to the Corporation established in accordance with the Principal Act; and that last- mentioned Corporation shall take all such steps within their power as may be necessary for giving full effect to the said transfer. BRISBANE. 14 N G o E . O 1 . 9 V . I. An Act to Amend "The City of Brisbane Acts, 1924 THE CITY OF BRISBANE ACTS to 1949," in certain particulars, and for AMENDMENT ACT OF other purposes. 1950. [ASSENTED TO 30TH NOVEMBER, 1950.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :-- Short title 1. This Act may be cited as " The Oity of Brisbane :::atruction. Acts Amendment Act of 1950," and shall be read as one with *" The Oity of Brisbane Acts, 1924 to 1949," herein referred to as the Principal Act. Collective The Principal Act and this Act may be collectively title. cited as " The Oity of Brisbane Acts, 1924 to 1950." Amendment 2. Subsection one of section five of the Principal ofB.5. Act is repealed and the following subsection is inserted in lieu thereof, namely :- "(1.) On and from the conclusion of the triennial election of the Mayor and aldermen to be holden in the year one thousand nine hundred and fifty-two, the City shall be governed by a Council composed of twenty-five aldermen, consisting of the Mayor and twenty-four other aldermen." * 15 G. 5 No. 32 and amending Acts.

Section fourteen of the Principal Ac~ is repealed ~ ; S~ ~ : f and the following section is inserted in lieu thereof, B. 14. namely:- " (14 1 J (1 ) For the purposes only of the election Ewlaercdtsoraanld of aldermen other than the Mayor, the CIty shall be, election of and is hereby, divided into twenty-four electoral wards. ~ ~ ~ ~ ~ ~ ~ One alderman shall be returned to the Council for each such ward. (2.) The names set out in the first column of the Table to this subsection shall be the names of the aforesaid twenty-four electoral wards respectively and the boundaries of each such electoral ward shall be the boundaries of that one of the twenty-four electoral districts into which the Metropolitan Zone is presently divided under and in pursuance of *" The Electoral Districts Act of 1949," which is named opposite and relative to that electoral ward in the second column of the said Table. Subject to this subsection, if and so often as the boundaries of the electoral districts named in the second column of the Table to subsection two of this section, or of any two or more of those electoral districts, are changed in pursuance of a complete or partial redistribution thereof made under *" The Electoral Districts Act of 1949," then, and in every such case, the boundaries of the respective electoral wards set out in the first column of the said Table opposite a.nd relative to the electoral districts affected by the complete or partial redistribution in question shall, by virtue of that redistribution, be deemed to be also changed so that the boundaries of those electoral wards shall respectively become and be the new boundaries as defined by that redistribution of the electoral districts affected thereby. If upon a complete or partial redistributIOn as aforesaid the name appearing in the Table to subsection two of this section of any electoral district is changed then the said Table shall be read by substituting that changed name for the name appearing as aforesaid." New s. 14A inserted. 4. The following section is inserted after section fourteen of the Principal Act, namely :- Present Council. " [14A.] (1.) In this section the term "present Council" means Brisbane City Council as duly constituted before and subsisting at the passing of t" The Oity of Brisbane Acts Amendment Act of 1950." (2.) The amendments made by t" The Oity of Brisbane Acts Amendment Act of 1950" to this Act shall not affect the power or authority of the present Counoil, which shall continue until the conclusion of the triennial election of the Mayor and aldermen next held after the passing of t" The Oity of Brisbane Acts Amendment Act of 1950." (3.) Every alderman (other than the Mayor) of the present Council shall continue to represent the electoral ward as constituted and as represented by him immediately prior to the passing of t" The Oity of Brisbane Acts Amendment Act of 1950" until he dies, resigns, or his office as alderman is otherwise vacated, or the triennial election of the Mayor and aldermen next held after the passing oft" The OityofBrisbane Acts Amendment Act of 1950 " is concluded. * 13 G. 6 No. 22. t This Act.

If an alderman, other than the Mayor, of the present Council dies, resigns, or his office is other-wise vacated prior to the conclusion of the triennial election of the Mayor and aldermen next held after the passing of *" The Oity of Brisbane Acts Amendment Act of 1950," any separate electIOn for filling that vacancy shall be held for the electoral ward represented by him as constituted immediately prior to the passing of *" The City of Brisbane Acts Amendment Act of 1950." 5. The following section is inserted after section ~ ew s. I4B 14A of the Principal Act, as previously inserted by this lUserted. Act, namely :- "[14B.] (1.) (2.) A oomplete or partial redistribution of eleotoral districts as aforesaid shall not affect the power or authority of the existing Council, which shall continue until the conclusion ofthe triennial election ofthe Mayorand aldermen next held after the completion of that redistribution. (3.) Every alderman, other than the Mayor, of the existing Council shall continue to represent the. electoral ward as oonstituted and as represented by him immediately prior to the complete or partial redistribution as aforesaid in question until he dies, resigns, or his office as alderman is otherwise vacated or the triennial election of the Mayor and aldermen next held after that redistribution is concluded. (4.) If an alderman, other than the Mayor, of the existing Council dies, resigns, or his office is otherwise vaoated prior to the conclusion of the triennial eleotion of the Mayor and aldermen next held after a complete or partial redistribution as aforesaid, any separate election for filling that vacancy shall be held for the electoral ward represented by him as constituted immediately prior to that complete or, as the case may be, partial redistribution." ... Subsection two of section sixteen of the Principal Act is repealed and the following subsection is inserted in lieu thereof, namely:- Rofefitcuerrn. ing unde"r t(h2.i)s FAocrt, twhheetphuerrpoastersienonfiaa.nl yeleacntidonevoefrtyheelMecatyioonr and aldermen or a separate election by the electors of an electoral ward to fill an extraordinary vacancy in the office of alderman fot that ward- (a) The Town Clerk shall be the returning officer; and (b) Each and every person holding under the ElectionsAct for the time being the office of returning officer for an electoral district named in the Table to subsection two of section fourteen of this Act shall (by virtue of his commission of appointment as such returning officer and without further or other appointment whatsoever) be the assistant returning officer for the electoral ward, the boundaries whereof are formed by the boundaries of the electoral district so named.". Amendment of s. 18 (2). 7. Subsection two of section eighteen of the Principal Act is amended by repealing the words "within one month" where those words appear in the second paragraph of that subsection and by inserting the words " within two months" in lieu of those repealed words.
