610 ( itPeltshtlttr ANNO VICESIMO TERTIO ELIZABETHAE SECUNDAE REGINAE No. 62 of 1974 An Act to amend the Cityof BrisbaneAct 1924-1973 in certain particulars [ ASSENTED TO 27TH SEPTEMBER, 1974] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Cityof Brisbane Act Amencinent Act 1974. (2) In this Act the Citr of Brisbane Act 1924-1973 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Citr of Brisbane Act 1924-1974.
City of Brisbane Act Amendment Act 1974, No. 62 611 2. Amendment of s. 4 . City of Brisbane . Section 4 of the Principal Act is amended by adding after subsection (2) the following subsection:- " (3) Notwithstanding subsection (2), the Area of the City of Brisbane includes the whole of Bishop. Fisherman. Green. Moreton, Mud and St. Helena Islands (being islands situated in or adjacent to Moreton Bay) above low water mark.". 3. Amendment of s. 14P. Proclamation of electoral wards. Section 14P of the Principal Act is amended by adding the following subsections:- " (6) The electoral ward of Waterloo Bay as constituted immediately before the commencement of the City of Brisbane Act Amendment Act 1974 includes, on and from such commencement but subject to any complete or partial redistribution made under this Act, the islands as specified in subsection (3) of section 4 (other than Moreton Island as so specified) and the electoral roll for that electoral ward shall, as the circumstances may require, be amended accordingly. (7) The electoral ward of Bramble Bay as constituted immediately before the commencement of the City of Brisbane Act Amendment Act 1974 includes, on and from such commencement but subject to any complete or partial redistribution made under this Act, Moreton Island as specified in subsection (3) of section 4 and the electoral roll for that electoral ward shall, as the circumstances may require, be amended accordingly. (8) The amendment of this Act by the City of Brisbane Act Amendment Act 1974 shall not affect- (a) the power and authority of the Council as constituted immediately before the commencement of that Act and the Council as so constituted shall continue and govern the City as constituted on the said commencement until the conclusion of the triennial election of aldermen next held after the said commencement; (b) the office of the alderman of the Council (as constituted immediately before the commencement of the Citt' of Brisbane Act Amendment Act 1974) representing the electoral ward of Waterloo Bay, and that alderman shall hold and continue to hold office as the alderman representing the electoral ward of Waterloo Bay in all respects as if he had been duly elected at an election for that electoral ward as constituted on the commencement of this Act until he dies, resigns his office or his office as alderman is otherwise vacated, or the triennial election of aldermen next held after the said commencement is concluded, whichever first occurs; (c) the office of the alderman of the Council (as constituted immediately before the commencement of the Cit}' of Brisbane Act Amendment Act 1974) representing the electoral ward of Bramble Bay, and that alderman shall hold and continue to hold office as the alderman
612 City of Brisbane Act Amendment Act 1974, No. 62 representing the electoral ward of Bramble Bay in all respects as if he had been duly elected at an election for that electoral ward as constituted on the commencement of this Act until he dies, resigns his office or his office as alderman is otherwise vacated, or the triennial election of aldermen next held after the said commencement is concluded whichever first occurs.".
