City Area Leases (Amendment) Ordinance

An Ordinance to amend the City Area Leases Ordinance 1936

Short title

1. This Ordinance may be cited as the City Area Leases (Amendment) Ordinance 198 3 J

Principal Ordinance

2. In this Ordinance, "Principal Ordinance" means the City Area Leases Ordinance 1936}

(a) by omitting from sub-paragraph (3) (b) (ii) "or"; and

Assignment, mortgage, &c, of lease where building required to be erected on the land

3. Section 28 of the Principal Ordinance is amended by inserting in paragraph (2B) (a) "in pursuance of an order made by the Family Court of Australia or any other court having jurisdiction under the Family Law Act 1975 or" after "or except".

Restriction on transfer of leases of land with dwelling-houses

4. Section 28A of the Principal Ordinance is amended—

(b) by inserting after sub-paragraph (3) (b) (iii) the following word and sub-paragraph:

"; or (iv) in pursuance of an order made by the Family Court of Australia or any other court having jurisdiction under the

Family Law Act 1975.".

Restrictions on transfer, &c, of certain leases

5. Section 28B of the Principal Ordinance is amended by inserting after

paragraph (3) (g) the following word and paragraph:

"; or (h) a transaction entered into in pursuance of an order made by the Family Court of Australia or any other court having jurisdiction under the Family Law Act 1975:'.

Restrictions on transfer, &c, of leases where reserve price for the lease not paid by lessee in full

6. Section 28DA of the Principal Ordinance is amended by inserting after

paragraph (2) (a) the following paragraph:

"(aa) the transfer or assignment of the lease in pursuance of an order made by the Family Court of Australia or any other court having jurisdiction under the Family Law Act 1975;".
