AN ORDINANCE

To amend the City Area Leases Ordinance 1936-1975, as

amended by the City Area Leases Ordinance 1976.

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government {Administra­ tion) Act 1910-1973.

CITY AREA LEASES ORDINANCE (No. 2) 1976

1. (1) This Ordinance may be cited as the City Area Leases Ordi­ nance (No. 2 ) 1976.*
(2 ) The City Area Leases Ordinance 1936-1975,f as amended by the City Area Leases Ordinance 1976,i; is in this Ordinance referred to as the Principal Ordinance.

(3 ) Section 1 of the City Area Leases Ordinance 1976 is amended by omitting sub-section ( 3 ) .

(4 ) The Principal Ordinance, as amended by this Ordinance, may be cited as the City Area Leases Ordinance 1936-1976.

2. Section 14 of the Principal Ordinance is amended—

t Ordinance N o . 12, 1976.

(a)

by omitting from sub-section (12) the words "An amount" and substituting the words " Subject to sub­ section ( 1 3 ) , an amount" ; and

(b) by adding at the end thereof the following sub-section:—
" (13) Where a person who becomes the successful
applicant for the right to the grant of a lease fails to comply
with sub-section ( 6 ) , (7 ) or ( 9 ) , an amount lodged by
way of deposit with the application made by that person

under this section is, by force of this sub-section, forfeit to

the Commonwealth.".

3. (1) Section 14 of the Principal Ordinance, as amended by this Ordinance, applies in relation to applications made under that section on or after the date of commencement of this Ordinance.

(2) Section 14 of the Principal Ordinance as in force immediately before the commencement of this Ordinance continues to apply in rela­ tion to applications made under that section before the date of com­ mencement of this Ordinance.
