AN ORDINANCE

To amend the Church of England Property Trust

Ordinance 1928.

BE it ordained by the Governor-General in and over the Executive Council, in pursuance of the powers conferred by the Commonwealth of Australia, with the advice of the Federal	Seat of Government Acceptance Act 1909-1938 and the Seat of
Government (Administration) Act 1910-1940, as follows:—

1.—(1.) This Ordinance may be cited as the Church of short title

England Trust Property Ordinance 1941.	and cltatIon-
(2.) The Church of England Property Trust Ordinance 1928 is in this Ordinance referred to as the Principal Ordinance.
(3.) The Principal Ordinance., as amended by this Ordinance, may be cited as the Church of England Trust Property Ordinance 1928-1941.

2. Section three of the Principal Ordinance is amended by Definition!,

omitting the definition of " the Ac t" and inserting in its stead the
following definition:—

" ' the Act ' means the Church of England Trust Property Act, 1917 of the State of New South Wales, as amended by the Church of England Trust Property Amendment Act, 1923 and the Church of England Trust Property (Amendment) Act (No. 2), 1923 of that State;" .

3. After section fifteen of the Principal Ordinance the follow- ing sections are inserted:—

"16.—(1.) Sections five to eighteen (both inclusive), twenty-Application of

four to twenty-eight (both inclusive), thirty-one, thirty-two, thirty- pr̂ wona	seven to forty-two (both inclusive), and forty-five of the Act, shall ° , theAct-
apply in relation to the Territory as if the Territory were part of the State of New South Wales.
" (2.) For the purpose of applying section forty-two of the Act. to the Territory in accordance with sub-section (1.) of this section, that section shall be read as if after the word ' nineteen' there were inserted the words ' or under section four of the Church of England Trust Property Ordinance 1928-1941'.

Application of

" 17. In their application to the Territory of Jervis Bay, the provisions of this Ordinance, and the applied provisions of the Act, shall be construed, and deemed at all times to have been construed, as if any reference to the Diocese of Goulburn and to the Church of England Property Trust Diocese of Goulburn were references to the Diocese of Sydney and to the Church of England Property Trust Diocese of Sydney respectively.".
