Act No. 12, 1976.

An Act to amend the Church of England Constitutions Act Amendment Act of 1902. [Assented to, 31st March, 1976.]

Council and Legislative Assembly of New South Wales in BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative

Parliament assembled, and by the authority of the same, as follows:—

Constitutions (Amendment) Act, 1976".

1. This Act may be cited as the "Church of England

The Schedule to the Church of England Constitutions Act Amendment Act of 1902 is amended in the manner set forth in Schedule 1.

SCHEDULE 1.

(1) Preamble—

Omit the preamble.

(2) Article 1—

Omit "said Church of England in any Diocese now existing, or at any time hereafter to be constituted,", insert instead "Church of England in Australia in any Diocese".

(3) Article 2—

Omit "State: Provided always that nothing herein­ before contained shall be binding on such Diocese within a less period than three years after it has been constituted", insert instead "State".

(4) Article 6—

After "members" where secondly occurring, insert

"present and".

(5) Article 6—

Omit "five members", insert instead "eight members of one order".

SCHEDULE 1—continued.

(6) Article 6—

After "orders", insert "and, if a vote be taken by orders, a majority of members of each order present and voting shall be required".

( 7 ) Article 8 —

Omit "twenty-one years, being occupiers of seats in his church or residents within his parish", insert instead "eighteen years or over who are occupiers of seats in any church within his cure of souls or declare that they usually attend the regular church services in such a church".

( 8 ) Article 8 —

After "summoned", insert "and attending the meeting".

(9) Article 9—

After "England", insert "and not a member of any other Church".

(10) Article 10—

Omit "choose as representatives two male persons of the age of twenty-one years", insert instead "elect as representatives two persons of the age of eighteen years or over".

( 1 1 ) Article 1 1 —

Omit "or she".

SCHEDULE 1—continued.

(12) Article 14—

Omit "may" where firstly and fourthly occurring, insert instead "shall".

(13) Article 17—

After "communicant", insert "member".

(14) Article 17—

After "England", insert "and not a member of any other Church".

(15) Article 18—

Omit the article and the heading thereto.

(16) Article 19—

Omit the article and the heading thereto.

(17) Article 24—

Omit the article and the heading thereto.

(18) Article 26—

Omit "State", insert instead "Province".

(19) Article 26—

Omit "for the purpose of an ordinance of Synod, or in default of such an ordinance", insert instead "to administer the Diocese under the provisions of an ordinance of Synod or if no such appointment has been made".

SCHEDULE 1—continued.

(20) Article 28—

Omit "A copy", insert instead "Two copies".

(21) Article 28—

Omit "the same", insert instead "one copy".

(22) Article 28—

Omit "Archbishop of Canterbury", insert instead

"Primate of the Church".

(23) Article 29—

After Article 28, insert :—

Amendments.

29. These articles and provisions may be amended by an ordinance passed by the Provincial Synod of the Church in the Province of New South Wales and adopted by the Synod of each Diocese in that Province if the amendment is ratified by, or made in accordance with, a canon of the General Synod of the Church.
