Application for an Order to stop industrial action.

[1] This Decision was issued in transcript during the proceedings held on 30 September 2011.

[2] This matter involves an application for an Order to stop unprotected industrial action. These applications are of some serious gravity as orders made, if an application such as this is successful, might ultimately involve civil penalty if breaches occur. I am unable to conclusively determine this matter within the timeframe stipulated by section 420(1) of the Act. However, this afternoon I have been provided with sufficient evidence to persuade me that it would be appropriate and not contrary to the public interest to make an Interim order.

[3] The Interim Order [PR515212] is in terms broadly as sought by the applicant. As indicated in the Interim Order, it shall operate for a period of one month, or unless by way of further Order, or otherwise this application is determined. In that respect, the applicant has liberty to apply to have the matter subject to further hearing. I now issue and publish the Interim Order. My associate shall now provide multiple copies of the Interim Order to the parties. These proceedings now stand adjourned.
