DETERMINATION OF FEES FOR WATER SERVICES (CHRISTMAS ISLAND RESORT)
NO 1 OF 2007
I, NEIL BEDFORD LUCAS Administrator of Christmas Island, make this Determination under section 4 of the Utilities and Services Ordinance 1996.

1. Citation
This Determination may be cited as the Christmas Island Resort Water Services Fees and Charges Determination No 1 of 2007.
2. Commencement
This determination commences on 8 April 2007.
3. Fees and Charges
(1) Except as provided in paragraph 3(2) of this Determination, the fees and charges for the connection of water supply and the supply of water services and ancillary purposes to the location specified in Item A of the Schedule are as set out in the principal determination.
(2) The fixed fee charges for the provision of water services, and the water consumption charges:
(a) in the location specified in Item A of the Schedule; and
(b) in the circumstances specified in Item B of the Schedule,
are as set out in Items C and D of the Schedule.
4. Payment
The fees and charges set out in this determination must be paid in the manner, and by the date, or before the end of the period, specified in the principal determination.
5. Definitions
In this Determination -
"holiday accommodation" has the meaning given in the principal determination;
“principal determination” means the Christmas Islands Water and Sewerage Services Fees and Charges Determination No 1 of 2006 as amended from time to time, and any superseding determination;
“Soft Star” means Soft Star Pty Ltd and ABN 80 080 645 398 and its officers, employees and agents.

Item A - Location
Christmas Island Resort, located at Block 1 Section 1 Locality of Waterfall Crown Land Lease Volume 3017 Folio 241.
Item B - Circumstances
(a) The water is used by Soft Star only for the purpose of the operation of the Christmas Island Resort as holiday accommodation and ancillary purposes.
(b) The water is not:
(i) sold by Soft Star; or
(ii) discharged by Soft Star in a wasteful manner.
