(Relating to persons exempt from registration)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Chiropractors and Osteopaths Act 1991, has been pleased to make the Regulation set forth hereunder.

The Chiropractors and Osteopaths Regulation 1991 is amended by
inserting after clause 3 the following clause:
Certain students exempt from registration
3A. (1) A person who manipulates the joints of the human spinal column, including its immediate articulations, for therapeutic purposes is exempted from the operation of section 4 of the Act while the person does so in connection with a relevant course of study and training specified in subclause (2) and the manipulation is carried out in accordance with subclause (3).
(2) A relevant course is one for a degree, diploma or other award the holding of which is necessary or sufficient for registration as a medical practitioner or as a physiotherapist under the Physiotherapists Registration Act 1945.
(3) The manipulation must be carried out under the direct instruction and personal supervision of a person referred to in section 4 (a) or (b) of the Act.

EXPLANATORY NOTE
The object of this Regulation is to amend the Chiropractors and Osteopaths Regulation 1991 to prescribe an exemption from the requirement to be registered under the Chiropractors and Osteopaths Act 1991 before practising manipulation of the human spinal column.
The persons so exempted are those studying to be medical practitioners or physiotherapists who, as part of their studies, carry out spinal manipulation under the direct personal supervision of a registered chiropractor or of a person who can lawfully carry out spinal manipulation without being so registered.
The Regulation is made under sections 4 (e) and 65 (1) (the general
regulation-making power) of the Chiropractors and Osteopaths Act 1991.
