Children, Youth and Families (Children's Court Family Division) and Children's Court Criminal Procedure Amendment Rules 2024

The President of the Children's Court together with 2 magistrates for that Court jointly make the following Rules:

PART 1—PRELIMINARY

1Objects

The objects of these Rules are—

(a)to amend the Children, Youth and Families (Children's Court Family Division) Rules 2017 to update the forms for use in proceedings in the Family Division of the Children's Court—

(i)to provide for a principal officer of an Aboriginal agency as a consequence of amendments made by the Children and Health Legislation Amendment (Statement of Recognition, Aboriginal Self-determination and Other Matters) Act 2023; and

(ii)to accommodate certain applications being filed and issued electronically as a consequence of the introduction of a new case management system at the Children's Court; and

(iii)to make other minor and technical amendments; and

(b)to amend the form of a witness summons in the Children's Court Criminal Procedure Rules 2019 to provide for documents or things that contain confidential communications or protected health information.

2Authorising provisions

These Rules are made under section 588 of the Children, Youth and Families Act 2005 and all other enabling powers.

3Commencement

These Rules come into operation on 28 March 2024.

4Principal Rules

In these Rules, the Children, Youth and Families (Children's Court Family Division) Rules 2017[1] are called the Principal Rules.
