Children, Youth and Families Act 2005
Children, Youth and Families (Children's Court Family Division) and Children's Court Criminal Procedure Amendment Rules 2022
The President of the Children's Court together with 2 magistrates for that Court jointly make the following Rules:
Part 1—Preliminary
1Objects
The objects of these Rules are—
(a)to amend the Children, Youth and Families (Children's Court Family Division) Rules 2017—
(i)to incorporate an additional placement option for an interim accommodation order as a consequence of the enactment of the Disability (National Disability Insurance Scheme Transition) Amendment Act 2019; and
(ii)to provide for an affidavit of service and a declaration of service for use in proceedings in the Family Division of the Court; and
(iii)to make other minor and technical amendments; and
(b)to amend the Children's Court Criminal Procedure Rules 2019—
(i)to provide for a case direction notice to refer to a disclosure certificate served under section 110A of the Criminal Procedure Act 2009, as a consequence of amendments to that Act by the Justice Legislation Amendment (Criminal Procedure Disclosure and Other Matters) Act 2022; and
(ii)to update the form of an affidavit of service and a declaration of service as a consequence of the enactment of the Justice Legislation Amendment (System Enhancements and Other Matters) Act 2021.
2Authorising provisions
These Rules are made under section 588 of the Children, Youth and Families Act 2005 and all other enabling powers.
3Commencement
These Rules come into operation on 1 October 2022.
Part 2—Amendment of Children, Youth and Families (Children's Court Family Division) Rules 2017
Division 1—Amendments relating to interim accommodation orders and service of documents
4Form 10—Protection application
(1)In the heading to Form 10 of the Children, Youth and Families (Children's Court Family Division) Rules 2017[1], for "Form 10" substitute "Form 10—Protection application".
(2)In Form 10 of the Children, Youth and Families (Children's Court Family Division) Rules 2017 omit all words and expressions beginning "Reverse" and ending "Delete if not applicable".
5Form 12—Interim accommodation order
(1)In the heading to Form 12 of the Children, Youth and Families (Children's Court Family Division) Rules 2017, for "Form 12" substitute "Form 12—Interim accommodation order".
(2)In Form 12 of the Children, Youth and Families (Children's Court Family Division) Rules 2017, after—
"*placed with a disability service provider within the meaning of the Disability Act 2006."
insert—
