Commencement 2. This regulation commences on 3 November 1991.
2 Children’s Services Amendment Regulation 1991 Amended regulations 3. The Children’s Services Regulations 1966 are amended as set out in this regulation. Name of provision units 4. (1) A provision of the Children’s Services Regulations 1966 that was, immediately before the commencement of this section, called a regulation may be called a section. (2) A provision of the Children’s Services Regulations 1966 that was, immediately before the commencement of this section, called a subregulation may be called a subsection. (3) A reference in the Children’s Services Regulations 1966 to a regulation or subregulation of the regulations designated by a number is a reference to a section or subsection of the regulations designated by that number. Replacement of s.1 (Short title) 5. Section 1— omit , insert— ‘Short title ‘1. This regulation may be cited as the Children’s Services Regulation 1966 . ’. Omission of s.2 (Parts) 6. Section 2— omit .
Children’s Services Amendment Regulation 1991 3 Replacement of s.54 7. Section 54— omit , insert— ‘Rate of payment to foster parents ‘54. (1) In this section— “first placement” means the first instance that a child in the custody, temporary custody or guardianship of the Director is placed in the charge of a foster parent, and does not include a subsequent placement. ‘(2) For the purposes of section 108 of the Act, the prescribed sum, in relation to a first placement, is the aggregate of— (a) the amount (if any) that the Director considers should be paid towards the cost of outfitting the child, but not more than— (i) $195 – if the child is less than 12 years of age; or (ii) $239 – if the child is 12 years of age or older; and (b) if the child is— (i) less than 1 year old – $55.80 for each week of the placement; or (ii) 1 year or older but not 5 years old - $65.50 for each of the first 4 weeks of the placement, and then $55.80 for each week; or (iii) 5 years or older but not 12 years old – $85.10 for each of the first 4 weeks of the placement, and then $67.70 for each week; or (iv) 12 years or older but not 16 years old – $102.90 for each
4 Children’s Services Amendment Regulation 1991 week of the placement; or (v) 16 years or older – $99.20 for each week of the placement. ‘(3) For the purposes of section 108 of the Act, the prescribed sum, in relation to a subsequent placement, is the aggregate of— (a) the amount (if any) that the Director considers should be paid towards the cost of outfitting the child, but not more than— (i) $195 – if the child is less than 12 years of age; or (ii) $239 – if the child is 12 years of age or older; and (b) if the child is— (i) less than 5 years old - $55.80 for each week of the placement; or (ii) 5 years or older but not 12 years old - $67.70 for each week of the placement; or (iii) 12 years or older but not 16 years old - $102.90 for each week of the placement ; or (iv) 16 years or older - $99.20 for each week of the placement. ’. Please comment on – (a) the person’s physical health; and (b) the person’s mental and emotional stability; and (c) whether the person is psychologically suitable to be a foster parent; and (d) the length of time you have treated this patient. If the person suffers from a physical or other condition that, in your opinion, may affect the decision on the person’s suitability to become a foster parent, please provide details of that condition. 2. This report will be treated as strictly confidential and its contents will not
