Children's Protection (Notification) Amendment Act 2013

An Act to amend the Children's Protection Act 1993.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Children's Protection (Notification) Amendment Act 2013.

2Commencement

This Act will come into operation on a day to be fixed by proclamation.

3Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Children's Protection Act 1993
4Amendment of section 11 – Notification of abuse or neglect

Section 11—after subsection (2) insert:

  1. (2a)

    In proceedings for an offence against subsection (1), it is a defence for the defendant to prove that his or her suspicion was due solely to having been informed of the suspected abuse or neglect by a police officer acting in the course of his or her official duties.

  2. (2b)

    In proceedings for an offence against subsection (1), it is a defence for the defendant to prove that—

    1. (a)

      his or her suspicion was due solely to having been informed of the suspected abuse or neglect by another person to whom this section applies; and

    2. (b)

      he or she believed on reasonable grounds that the other person had given a notification under this section in respect of the suspected abuse or neglect.
