AMENDMENT h It enacted by the King's Most Excellent :Majesty, AOTOF 1930. by and with the advice and consent of the Legis- lative Assembly of Queenslandin Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Ohildren's Courts Short title Act Amendment Act of 1930," and shall be read as one and . with *" The Ohildren's Oourts Act of 1907" (as amended constructIOn. by t" The State Ohildren Act of 1911 "), herein referred . to as the Principal Act. The Principal Act and this Act may collectively be cited as "The Ohildren's Oourts Acts, 1907 to 1930." Amendments of the Principal Act. 2. The following words are added to the definition Amendment of "Children's Court" in section two of the Principal of s. 2. No. 29, the Governor in Council of a Magistrate for the Petty Sessions District of Brisbane, as prescribed in section 3A of this Act, and the Children's Court as constituted by the appointment by the Governor in Council of a Magistrate for any other Petty Sessions District, as prescribed in section 3B of this Act." Amendment 3. Subsection four of section three of the Principal of s. 3. Act is amended by the insertion of the words" Subject to section 3A of this Act" before the words" Within the Metropolitan." 4. Such Magistrate (who shall be a Justice of the Peace) may be t,he Director of the State Children Department or any other officer of the Public Service, and shall hold the office of "Magistrate of Children's Courts" in conjunction with any office under the Public Service Acts which he holds at the date of his appoint- ment as "Magistrate of Children's Courts." Such Magistrate appointed as aforesaid shall, within the Petty Sessions District of Brisbane, have and exercise the like powers, authorities, and jurisdiction as are had and exercised by a Police Magistrate sitting alone and constituting a Children's Court under *" The Ohildren's Oourts Act of 1907," and the Children's Court so constituted for the Petty Sessions District of Brisbane aforesaid shall be and be deemed for all purposes to be a "Children's Court" under *" The Ohildren's Oourts Act of 1907," and such Children's Court so constituted shall have and exercise all the powers, authorities, and jurisdiction -- ~ -~ - -- ~ - * 7 Edw. Children's COl.l1'ts Act Amendment Act. of a " Children's Court" under *" The Ckildren's Courts Acts, 1907 to 1930," and t" The State Children Acts, 1911 to 1928" (and any other Act amending or in substitution of such Acts.) , 'Within the said Petty Sessions District·of Brisbane the Children's Court constituted as aforesaid shall sit in one of the rooms of the State Children Department. [3n. ] The provisions of section 3A of this Act may Exte~ l~ ion of be extended by the Governor in Council by Order in prOVlSIOIlS. Council published in the Gazette, to apply to any other Petty Sessions District embracing a city or town in the State, to the intent that a Children's Court may be likewise constituted for such district by the appointment of a Magistrate to be the "Magistrate of Children's Courts" for such district; and the provisions of section 3A of this Act so extended shall mutatis mutandis apply and extend accordingly." 5. The Governor in Council may also from time to Associate t.ime appoint one or more p . ersons of either sex to be mCoeumrbt.ers of associated with the Children's Court, either specially for the purposes of any particular case or class of cases or generally in relati.on to all matters that may be dealt with by that Court. Such persons shall be appointed on the ground of special knowledge or experience deemed to be of advantage to the Court in the exercise of its diqol'etionary powers under thifl Act. or The decision of the Court in anv case shall not be dependent on the concurrence any persons so associated with the Court, but in all other respects all persons so associated with a Children's Court shall be deemed to be members of that Court. A notice in the Gazette of the appointment of any person as aforesaid shall be sufficient evidence of such appojntment. 6. vVhere in any Act reference is made to t"TheApplication Children's Cmtrts Acts of 1907" such reference shall for of Act. all purposes be read as the Principal Act as amended by this Act. * -; I:dw.
