Children's Court Criminal Procedure Amendment Rules 2020

The President of the Children's Court together with 2 magistrates for that Court jointly make the following Rules:

1Object

The object of these Rules is to amend the Children's Court Criminal Procedure Rules 2019 to provide for acknowledgement of certain consents by oral or written means.

2Authorising provisions

These Rules are made under section 588(1A) of the Children, Youth and Families Act 2005 and section 419 of the Criminal Procedure Act 2009 and all other enabling powers.

3Principal Rules

In these Rules, the Children's Court Criminal Procedure Rules 2019[1] are called the Principal Rules.

4Form 7 amended

In Form 7 of the Principal Rules, for "[Signature of child]       [Signature of parent]" substitute—

"[Acknowledgment by child:  *orally/*by signature]

[Acknowledgment by parent:  *orally/*by signature]".

5Form 8 amended

In Form 8 of the Principal Rules, for "[Signature of child]       [Signature of parent]" substitute—

"[Acknowledgment by child:  *orally/*by signature]

[Acknowledgment by parent:  *orally/*by signature]".

6Form 10 amended

In Form 10 of the Principal Rules, for "[Signature of child]" substitute "[Acknowledgment by child:  *orally/*by signature]".

7Form 11 amended

In Form 11 of the Principal Rules, for "[Signature of child]" substitute "[Acknowledgment by child:  *orally/*by signature]".

8Form 12 amended

In Form 12 of the Principal Rules, for "[Signature of child]" substitute "[Acknowledgment by child:  *orally/*by signature]".

9Form 13 amended

In Form 13 of the Principal Rules, for "[Signature of child]" substitute "[Acknowledgment by child:  *orally/*by signature]".

10Form 13A amended

In Form 13A of the Principal Rules—

(a)for "[Signature of child]" substitute "[Acknowledgment by child:  *orally/*by signature]";

(b)for "[Signature of parent]" substitute "[Acknowledgment by parent:  *orally/*by signature]".
