Children's Court Amendment Rule 2020

Children's Court Act 1987

Her Excellency the Governor, with the advice of the Executive Council, has made the following

Rule under the Children’s Court Act 1987.

Explanatory note

The objects of this Rule are as follows—

(a) to enable the Secretary of the Department of Communities and Justice to nominate 3 persons with expertise in youth justice, law reform and child protection for appointment to the Children’s Court Advisory Committee,
(b) to make minor amendments of a law revision nature.

This Rule is made under the Children’s Court Act 1987, including sections 15A(1) and 23 (the general rule-making power).

1      Name of Rule

This Rule is the Children’s Court Amendment Rule 2020.

2      Commencement

This Rule commences on the day on which it is published on the NSW legislation website.

Schedule 1 Amendment of Children’s Court Rule 2000

[1]      Clause 15B Electronic filing of documents

Omit “Department of Family and Community Services” from clause 15B(2)(a).

Insert instead “Department of Communities and Justice”.

[2]      Clause 37 Composition of Children’s Court Advisory Committee

Omit “Department of Justice” from clause 37(1)(c)(ii).

Insert instead “Department of Communities and Justice (the Secretary)”.

[3]      Clause 37(1)(c)(iv)–(vi)

Omit clause 37(1)(c)(iv) and (v). Insert instead—

(iv)      a person nominated by the Secretary who has qualifications or experience in youth justice,

(v)      a person nominated by the Secretary who has qualifications or experience in law reform,

(vi)      a person nominated by the Secretary who has qualifications or experience in child protection,

[4]      Clause 37(1)(c)(ix) and (x)

Omit “Executive Director of Juvenile Justice, Department of Justice and the Minister for
Family and Community Services” wherever occurring.

Insert instead “Minister for Families, Communities and Disability Services”.

[5]      Clause 37(2)(c)

Omit the paragraph. Insert instead—

(c) children’s services (within the meaning of the Children (Education and

Care Services) National Law (NSW)),
