Children’s Court Amendment (Existing Children’s Registrars) Regulation 2010

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Children’s Court Act 1987.

Explanatory note
Schedule 2.2 [7] to the Children Legislation Amendment (Wood Inquiry Recommendations) Act 2009 amends section 10A of the Children’s Court Act 1987 to provide that a person cannot be employed as a Children’s Registrar unless the person is an Australian lawyer.
The object of this Regulation is to provide that an existing Children’s Registrar who is employed as an officer in the Public Service, but who is not an Australian lawyer, may continue to be employed as a Children’s Registrar.
This Regulation is made under the Children’s Court Act 1987, including clause 1 of

Schedule 2.

1      Name of Regulation

This Regulation is the Children’s Court Amendment (Existing
Children’s Registrars) Regulation 2010.

2      Commencement

This Regulation commences on 24 January 2010 and is required to be published on the NSW legislation website.

10      Savings and transitional provision—existing Children’s Registrars

(1) Section 10A (1A) of the Act, as inserted by Schedule 2.2 [7] to the Children Legislation Amendment (Wood Inquiry Recommendations) Act 2009, does not apply in relation to a person who, immediately before the commencement of this clause, was employed as an officer under the Public Sector Employment and Management Act 2002 in the position of Children’s Registrar.

(2) Subclause (1) does not apply in relation to any such person
acting in the position of Children’s Registrar.
