HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Children (Interstate Transfer of Offenders) Act 1988, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Children (Interstate Transfer of Offenders) Regulation 1995.

Commencement

2. This Regulation commences on 1 September 1995.

Definition

3. In this Regulation:

“The Act” means the Children (Interstate Transfer of Offenders) Act

1988.

Legislation of other States dealing with the interstate transfer of young offenders

4. For the purposes of section 4 (2) of the Act, the following States are declared to have enacted legislation dealing with the interstate transfer of young offenders:

Australian Capital Territory
Northern Territory
South Australia
Victoria

Repeal

5. The Children (Interstate Transfer of Offenders) Regulation 1989 is repealed.

EXPLANATORY NOTE

The object of this Regulation is to repeal and remake the provisions of the Children (Interstate Transfer of Offenders) Regulation 1989. The Regulation declares other States and Territories that have enacted legislation dealing with the interstate transfer of young offenders. This enables the Minister to enter into agreements with those States and Territories for the transfer of young offenders between them and New South Wales.

This Regulation comprises or relates to matters arising under legislation that is
substantially uniform or complementary with legislation of another State or Territory.

This Regulation is made under the Children (Interstate Transfer of Offenders) Act 1988, including section 22 (the general regulation making power) and section 4.

This Regulation is made in connection with the staged repeal of subordinate legislation under the Subordinate Legislation Act 1989.
