His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Children (Criminal Proceedings)

Act 1987.

Explanatory note

The object of this Regulation is to update the list of officers of the Department of Juvenile Justice who are authorised officers for the purposes of Division 5 of Part 3 of the Children (Criminal Proceedings) Act 1987. That Division provides that authorised officers may apply to the Children’s Court for a variation of recognizance or probation or for the enforcement of conditions of recognizance or probation, imposed under the Act.

This Regulation is made under the Children (Criminal Proceedings) Act 1987, including section 51 (the general regulation-making power) and

section 39.

1 Name of Regulation

This Regulation is the Children (Criminal Proceedings)

Amendment (Authorised Officers) Regulation 1997.

2 Note

The explanatory note does not form part of this Regulation.

3 Amendment of clause 10 (1) of Children (Criminal Proceedings) Regulation 1995

The Children (Criminal Proceedings) Regulation 1995 is amended by omitting clause 10 (1) and by inserting instead the following subclause:

The following officers of the Department of Juvenile Justice are declared to be authorised officers for the purposes of Division 5 of Part 3 of the Act:

the Director-General,
the Director, Operations,
Cluster Directors,
Managers, Juvenile Justice Community Services,
Assistant Managers, Juvenile Justice Community
Services,
Managers, Intensive Programs Units,
Managers, Attendance Centre Programs,
Senior Counsellors, Intensive Programs Units,

Juvenile Justice Officers,

Juvenile Justice Counsellors,
Specialist Services Coordinators.
