REGULATION

(Relating to enforcement of fines)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Children (Community Service Orders) Act 1987, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 9 February 1990.

Amendment

2. The Children (Community Service Orders) Regulation 1988 is

amended:

(a) by omitting clauses 15-18 and by inserting instead the following clauses:

Form of order for fine defaulters

15. For the purposes of section 5A (1) of the Act, Form 1 is

the prescribed form.

Notices under section 12 (3) of the Act

16. For the purposes of section 12 (3) (a) of the Act, a copy of the order referred to in that paragraph may be served personally or by post.

(b)

by omitting Form 1 in Schedule 1 and by inserting instead the following form:

EXPLANATORY NOTE

The object of this Regulation is to amend the Children (Community Service Orders) Regulation 1988, as a result of the commencement of amendments to the Children (Community Service Orders) Act 1987 contained in the Fine Enforcement Legislation (Amendment) Act 1989:

(a)

to prescribe the form of children’s community service order for fine defaulters; and

(b) to omit certain clauses.
