Children and Community Services (Outside School Hours Family Day Care) Amendment

Regulations 2007

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Children and Community Services
(Outside School Hours Family Day Care) Amendment
Regulations 2007.

Note: Under the Interpretation Act 1984 section 25(3), these regulations take effect on the day on which the Child Care Services Act 2007 section 52 commences.

2.           The regulations amended

The amendments in these regulations are to the Children and
Community Services (Outside School Hours Family Day Care)
Regulations 2006.

3.            Regulation 1 amended

Regulation 1 is amended by deleting "Children and
Community" and inserting instead -

4.            Regulation 3 amended

Regulation 3 is amended as follows:

(a) care licence" by deleting "the Act section 205(1)" and

in the definition of "outside school hours family day " section 13 ";

(b) by inserting in the appropriate alphabetical position -

5.            Regulation 6 amended

Regulation 6 is amended by deleting "Under the Act section 232(a), an" and inserting instead -

6.            Regulation 7 amended

Regulation 7 is amended by deleting "the Act section 204(2)(d)" and inserting instead -

44 section 12(2)(c) ".

Note: The heading to regulation 7 will be altered by deleting 'the Act

section 204(2)(d)" and inserting instead 'section 12(2)(c)".

7.            Regulation 8 amended

Regulation S is amended as follows:

(a) by deleting "the Act section 210" and inserting instead -

(b) in paragraph (d) by deleting "the Act section 213(l)." and inserting instead -

46 section 19(1). ".

Note: The heading to regulation 8 will be altered by deleting 'the Act

section 210" and inserting instead 'section 33".

8.           Regulation 9 amended

Regulation 9 is amended by deleting "the Act section 217(2)(b)" and inserting instead -

44 section 22(2)(b) ".

9.            Regulation 10 amended

(1)	Regulation 10(1) is amended by deleting "the Act section 203(b)" and inserting instead -
44 section 11(b) ".
(2)	Regulation 10(2) is amended by deleting "the Act
section 217(2)(c)" and inserting instead -

Regulation 11(1) is amended by deleting "the Act section 215" and inserting instead -

Regulation 12(4) is amended by deleting "the Act section 207' and inserting instead -

12.          Regulation 17 amended

Regulation 17(2) is amended by deleting "the Act

section 224(2)" and inserting instead -

13.          Regulation 20 amended

(1) Regulation 20(1) is amended as follows:

(a) after paragraph (a) by inserting -

and ";

(b)	after paragraph (b) by deleting "; and" and inserting a full stop instead;
(c)	by deleting paragraph (c).

(2) After regulation 20(1) the following subregulation is inserted -

"

(la) A licensee must notify the chief executive officer of the

department of the Public Service principally assisting

in the administration of the Children and Community

Services Act 2004 of any allegation of abuse, neglect or

assault, including sexual assault, of an enrolled child

during a care session, or of an offence under The

Criminal Code Chapter XXII committed against an

enrolled child during a care session, that is made against the licensee, a supervising officer, a usual occupant of the place or a volunteer. ',

(3) Regulation 20(2) is amended as follows:

(a) by deleting "The notification" and inserting instead -

(b) by deleting "made." and inserting instead -

(4) Regulation 20(3) is amended as follows:

(a) by deleting "CEO" and inserting instead -

14.          Regulation 22 amended

Regulation 22(1) is amended by deleting "the Act section 212"

and inserting instead -

15.          Regulation 72 amended

Regulation 72(1) is amended as follows:

(a)

by deleting "the Act section 232(r)" and inserting " Schedule 1 item 18 to the Act

(b) by deleting "Part 8".
