Child Wellbeing and Safety (Information Sharing) Amendment Regulations 2025

The Governor in Council makes the following Regulations:

1Objectives

The objectives of these Regulations are to amend the Child Wellbeing and Safety (Information Sharing) Regulations 2018—

(a)to further prescribe the Secretary to the Department of Education as an information sharing entity for the purposes of Part 6A of the Child Wellbeing and Safety Act 2005; and

(b)to make other minor and technical amendments.

2Authorising provisions

These Regulations are made under sections 46ZC and 47 of the Child Wellbeing and Safety Act 2005.

3Commencement

These Regulations come into operation on 2 July 2025.

4Principal Regulations

In these Regulations, the Child Wellbeing and Safety (Information Sharing) Regulations 2018[1] are called the Principal Regulations.

5Schedule 1 amended

(1)In item 4 of Schedule 1 to the Principal Regulations, for "Director of Housing" substitute "Chief Executive Officer, Homes Victoria".

(2)For item 6 of Schedule 1 to the Principal Regulations substitute

"6An out of home care service within the meaning of section 3(1) of the Children, Youth and Families Act 2005, to the extent that the out of home care service performs the functions of an out of home care service.".

(3)For item 8 of Schedule 1 to the Principal Regulations substitute

"8A mental health and wellbeing service provider within the meaning of section 3(1) of the Mental Health and Wellbeing Act 2022, to the extent that the mental health and wellbeing service provider performs functions relating to the provision of mental health and wellbeing services.".

(4)For item 30(j) of Schedule 1 to the Principal Regulations substitute

"(j)that Department manages or delivers engagement services to children and young people, including children and young people at risk of disengaging with education; or".

(5)In item 30(k) of Schedule 1 to the Principal Regulations, for "programs." substitute "programs; or".

(6)After item 30(k) of Schedule 1 to the Principal Regulations insert

"(l)the Secretary performs functions as the head of an entity to which the reportable conduct scheme applies; or

(m)that Department performs a risk management function in relation to a child or group of children who are or were enrolled at a Government school.".

(7)In item 51 of Schedule 1 to the Principal Regulations, for "the Supported Residential Services (Private Proprietors) Act 2010" substitute "section 3(1) of the Supported Residential Services (Community Visitors) Act 2010".
