Child Wellbeing and Safety (Information Sharing) Amendment Regulations 2021

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Child Wellbeing and Safety (Information Sharing) Regulations 2018—

(a)to prescribe additional persons and bodies as information sharing entities for the purposes of Part 6A of the Child Wellbeing and Safety Act 2005; and

(b)to prescribe additional provisions for the purposes of section 41ZH of the Child Wellbeing and Safety Act 2005.

2Authorising provisions

These Regulations are made under sections 46ZC and 47 of the Child Wellbeing and Safety Act 2005.

3Commencement

These Regulations come into operation on 19 April 2021.

4Principal Regulations

In these Regulations, the Child Wellbeing and Safety (Information Sharing) Regulations 2018[1] are called the Principal Regulations.

5Regulation 6 substituted

For regulation 6 of the Principal Regulations substitute

"6   Application of this Part

(1)This Part applies to an information sharing entity in Schedule 1 other than an information sharing entity specified in item 57 or 58.

(2)Despite anything to the contrary in this regulation, a provision of this Part does not apply to an information sharing entity specified in item 12 of Schedule 1 if that information sharing entity reasonably believes that the information that the provision requires the information sharing entity to record has been recorded by another information sharing entity.".

6Regulation 10 amended

In regulation 10 of the Principal Regulations—

(a)in paragraph (d), for "Disability Act 2006." substitute "Disability Act 2006;";

(b)after paragraph (d) insert

"(e)sections 537(3) and 582(5) of the Children, Youth and Families Act 2005;

(f)sections 18(3) and 99A(5) of the Magistrates' Court Act 1989.".

7Schedule 1 amended

After item 56 of Schedule 1 of the Principal Regulations insert

"57 A court official within the meaning of section 3(1) of the Magistrates' Court Act 1989.
58 A court official within the meaning of section 3(1) of the Children, Youth and Families Act 2005.".
