I, PHILIP MICHAEL JEFFERY, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Child Support (Registration and Collection) Act 1988.

1Name of Regulations

These Regulations are the Child Support (Registration and Collection) Amendment Regulations 2004 (No. 1).

2Commencement

These Regulations commence on the date of their notification in the Gazette.

3Amendment of Child Support (Registration and Collection) Regulations 1988

Schedule 1 amends the Child Support (Registration and Collection) Regulations1988.

insert

8Debts due to the Commonwealth

For paragraph 113 (1) (a) of the Act:

  1. (a)

    the place at which a debt is payable is any of the following:

    1. (i)

      the Child Support Agency;

    2. (ii)

      a payment agency that, by arrangement with the Child Support Agency, accepts such payments;

    3. (iii)

      a financial institution that, by arrangement with the Child Support Agency, maintains an account for receipt of such payments; and

  2. (b)

    the manner in which a debt is payable is:

    1. (i)

      if the payment is made to the Child Support Agency:

      1. (A)

        by cheque or money order; or

      2. (B)

        by electronic means capable of being processed by the Agency; or

    2. (ii)

      if the payment is made to a payment agency or financial institution — by a means capable of being processed by the payment agency or financial institution.
