Explanatory note
The object of this Regulation is to provide that the personal information that is required to be provided by a registrable person under the Child Protection (Offenders Registration) Act 2000 who does not generally reside at any particular premises must include details identifying the specific places where the person sleeps on a regular basis.
This Regulation is made under the Child Protection (Offenders Registration) Act 2000, including sections 9
(Relevant personal information to be reported) and 22 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Child Protection (Offenders Registration) Amendment
(Personal Information) Regulation 2015.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Child Protection (Offenders Registration) Regulation 2009

Clause 17A

Insert after clause 17:

17A Additional relevant personal information to be reported
(1) For the purposes of section 9 (1) (q) of the Act, the relevant personal information to be reported by a registrable person who does not generally reside at any particular premises includes details that are sufficient to identify the places where the person sleeps on a regular basis (for example, the name and address of any refuge, shelter or other similar premises, or any other specific place such as a park or beach, where the person sleeps on a regular basis).
(2) For the purposes of subclause (1), regular basis means more than once
in any period of 14 days.
(3) This clause extends to the personal information to be reported by a person who was, immediately before the commencement of this clause, a registrable person and who had not yet made an initial report of the person’s relevant personal information under section 9A of the Act.
