I, LARRY ANTHONY, Minister for Children and Youth Affairs, make this Determination under section 206 of the A New Tax System (Family Assistance) (Administration) Act 1999.

  1. Name of Determination

This Determination is the Child Care Benefit (Allocation of Child Care Places) Amendment Determination 2003 (No. 1).

2          Commencement

This Determination commences on gazettal.

3          Amendment of Child Care Benefit (Allocation of Child Care Places) Determination 2000

Schedule 1 amends the Child Care Benefit (Allocation of Child Care Places) Determination 2000.

Schedule 1       Amendments

(section 3)

[1]       Subsection 3(1), after definition of child care place

insert

JET child care place has the meaning given by paragraph 7(2)(c);

JET Program means the Jobs, Education and Training Program jointly administered by the Department and other Commonwealth departments;

parent means the individual in whose care the child is, or that individual’s partner;

[2]      Paragraphs 7(2)(a), (b) and (c)

substitute

(a) numbers of places which may be allocated in respect of children in particular age groups;

(b) for outside school hours care services, numbers of places which may be allocated in respect of before school care, after school care, and vacation care; and

(c) for family day care services, numbers of places which may be allocated to enable parents of children requiring this type of care to participate in activities under the JET Program (the JET child care places).

[3]          After subsection 7(4)

insert

(4A) A JET child care place may be allocated to a family day care service only for a child and for a period (the allocation period) determined by the Secretary as enabling the parent of the child to participate in an activity under the JET Program.

(4B) The Secretary may vary the allocation period to align it with the period of the parent’s participation in the activity under the JET Program, if the period of the participation differs from the allocation period as determined under subsection (4A) or as varied under this subsection.

(3)   If a JET child care place is allocated to an approved family day care service in accordance with subsection 7(4A), the notice under subsection (1) must specify the name of the child for whom the place is allocated and the period for which the place is allocated.

(4)   If the period of the allocation of a JET child care place is varied under subsection 7(4B), the Secretary must give the operator of the family day care service notice in writing specifying the period as varied.
