Chemical Usage (Agricultural and Veterinary) Control Amendment Regulation (No. 1) 2012 [s 1] 1 Short title This regulation may be cited as the Chemical Usage (Agricultural and Veterinary) Control Amendment Regulation (No. 1) 2012 . 2 Regulation amended This regulation amends the Chemical Usage (Agricultural and Veterinary) Control Regulation 1999. 3 Amendment of s 9 (Definitions for div 1) Section 9— insert— ‘ statement of attainment see the VocationalEducation,Training and Employment Act 2000 , schedule 3.’. 4 Insertion of new s 11C Part 4, division 1— insert— ‘11C Restricted chemical products containing copper, chromium and arsenic ‘(1) This section applies to a restricted chemical product with a formulation containing all 3 of the following as active constituents— (a) copper; (b) chromium; (c) arsenic. ‘(2) For subsection (1), an active constituent mentioned in subsection (1)(a), (b) or (c) includes the active constituent in any of its various chemical forms. ‘(3) A person must not use the product unless the person— (a) is authorised to use the product; or Page 2 2012 SL No. 162
Chemical Usage (Agricultural and Veterinary) Control Amendment Regulation (No. 1) 2012 [s 5] (b) holds a statement of attainment issued by a registered training organisation stating that the person has successfully completed— (i) the competency FPISAW3201A—(Treat Timber); or (ii) the competency FPISAW3201B—(Treat Timber); or (c) holds a qualification or has successfully completed training for using the product that the chief executive reasonably considers is substantially equivalent to a statement of attainment mentioned in paragraph (b). Maximum penalty—40 penalty units.’. 5 Amendment of s 12 (Other restricted chemical products) Section 12(1), from ‘containing’ to ‘virus’— omit, insert— ‘to which any of sections 10 to 11C apply’. 6 Replacement of pt 8 hdg Part 8 heading— omit, insert— ‘Part 8 Transitional provisions ‘Division 1 Transitional provisions for ChemicalUsage (Agricultural and Veterinary)Control Amendment Regulation(No. 1) 2009’. 7 Insertion of new pt 8, div 2 Part 8, division 2— insert— 2012 SL No. 162 Page 3
Chemical Usage (Agricultural and Veterinary) Control Amendment Regulation (No. 1) 2012 [s 7] ‘Division 2 Transitional provision for Chemical Usage (Agricultural and Veterinary) Control Amendment Regulation (No. 1) 2012 ‘32 Deferral of requirements for using restricted chemical products containing copper, chromium and arsenic ‘(1) This section applies to a person for using a restricted chemical product to which section 11C applies. ‘(2) Despite section 11C, the person is not required to comply with section 11C(3)(a), (b) or (c). ‘(3) This section stops applying on 1 January 2013.’.
