1. The appeal foreshadowed by this application for special leave to appeal would not turn on the resolution of any question of legal principle of general importance. Rather, it would turn on the resolution of a dispute as to the significance of the facts of the case, and, in that regard, the applicant's prospects of success are not such as to warrant the grant of special leave to appeal.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
