In this matter I am satisfied on the evidence, including counsel's advice, that the settlement of the action is reasonable and appropriate. I sanction that settlement.
I am also satisfied that on balance, as between the Public Trustee and Perpetual Trustee Company Limited, that Perpetual Trustee Company Limited be appointed the trustee.
While it is acknowledged in the submissions made on behalf of the plaintiff this morning that there is not much difference between the costs of the two trustees, that in this case Perpetual Trustee Company Limited be appointed the trustee, a draft order is available to me.
I have considered that draft order. In this matter there will be an order as per the draft, initialled by me and left with the papers.
