(1.) The Water Board for the water area of Charters Towers shall consist of six members, who shall be elected by the ratepayers of the water area. No. 8, meaning of the Local Authorities Aet, and the water area shall be deemed to be an Area and classed as a town without wards within the meaning of that Act. (3.) The members of the 'Vater Board shall be elected in manner provided by the Local Authorities Act, and notwithstanding anything contained in the Principal Act, the following provisions of the Local Authorities Act- namely: PART III. Subdivi. ~ ion II.-Qualification of Member's: Subdivision III.-Betirements and Vacancies: S1f,bdivision I"V.-Ouster from o ifioe : Subdivision "V. - Qualifioation of Voters (except section twenty-five thereof): PART I"V.-ELECTION OF MEMBERS: and the Rules as to Elections contained in the Third Schedule to that Act shall be applied accordingly so far as the same are applicable, subject, however, to the following modifications and provisions :- (a) Elections shall be held in every year in the water area at the same time and place as elections under and for the purposes of the Local Authorities Act are appointed to be held, or if no such elections are appointed to be held then on such day of the first seven 'days of l'ebruary in every year and at such place as the returning officer under the Local Authorities Act shall appoint for the City of Charters Towers, but separate ballot-papers and ballot-boxes shall be provided and used; (b) At the first election the whole number of mem- bers of the Water Board shall be elected, and at the conclusion of that election all the late members of the Board appointed under the Principal Act shall go out of office, unless they or any of them are re-elected j (c) If the water rat'es payable in respect of land, whether of one or more tenements, amount to less than five pounds, the ratepayer shall have one vote; if such rates amount to or exceed five pounds and are less than ten pounds, he shall have two votes; if such rates amount to or exceed ten pounds, he shall have three votes.

(d) The Governor in Council mav, bv Order in Council published in the Gazette, f~om time to time give all such directions and make all such orders as to him seem expedient in respect of any matters where the aforesaid provisionlil of the Local Authorities Act are inapplicable or inappropriate or insufficient; and every such Order in Council shall have the same effect as if it were enacted in this Act, and shall not be questioned in any proceedings whatsoever. 4. The Water Board shall provide, without any pay- Supply of ment, for use in the Reserve at Charters Towers known as ;: ~ !~ ~ :~ . Lissner Park, a supply of water not exceeding two million gallons in quantity in any year. And a further supply, not exceeding two million gallons in anyone year, shall be provided, without payment, for the use of such Reserves as are under the control of the Shire of Queenton.
