372 (Queenslans' ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 40 of 1964 An Act to Amend "The Charitable Funds Acts, 1958 to 1962 ," in a certain particular [ASSENTED TO 2ND NOVEMBER, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Charitable Funds Acts Amendment Act of 1964." (2) Principal Act . " The Charitable Funds Acts, 1958 to 1962 " are in this Act referred to as the Principal Act. (3) Collective title . The Principal Act and this Act may be collectively cited as " The Charitable Funds Acts, 1958 to 1964." 2. Amendment of s. 10 . Section ten of the Principal Act is amended by inserting after subsection (7), the following subsection- " (8) In any case referred to in section five of this Act the Governor in Council may by Order in Council provide that any fund the amount or value of the property wherein does not exceed the sum specified in the Order in Council (being a sum in excess of six hundred pounds) may be dealt with under and pursuant to this section notwithstanding the provisions of any other section of this Act.

Charitable Funds Acts Amendment Act of 1964, No. 40 373 The Governor in Council may provide, as prescribed by this subsection, in relation to a particular fund, or to funds included in a specific class of funds, or to funds generally. Every fund in respect whereof the Governor in Council makes provision as prescribed by this subsection may be dealt with under and pursuant to this section notwithstanding that the amount or value of the property therein exceeds six hundred pounds. A reference in this Act (other than in this section) to a fund described as a fund where the amount or value of the property therein does not exceed six hundred pounds shall include a fund, provision for which is made by the Governor in Council by Order in Council made under this subsection." 3. Application of Act. This Act shall apply to all funds raised before, or after, or partly before and partly after the passing hereof.
