Charitable Funds Act Amendment Act of 1962
12 ANNO UNDECIMO ELlZABETHAE SECUNDAE REGINAE ••••••••••••••••••••••••••••••••••••••••••••••••••• No. 4 of 1962 An Act to Amend "The Charitable Funds Act of 1958," in a certain particular [ASSENTED TO 11 TH 0cTOBER, 1962] Short title Principal Act Collective title B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) This Act may be cited as "The Charitable Funds Act Amendment Act of 1962." (2) "The CharitableFundsAct of 1958" is in this Act referred to as the Principal Act. (3) The Principal Act and this Act may be collectively cited as "The Charitable Funds Acts, 1958 to 1962."

Section ten of the Principal Act is amended by- A 0 rm s. en ] d0ments (a) adding to subsection (3) the following proviso:- "Provided that the certifying officer may, in his discretion, instead of giving notice as aforesaid, give such notice in such form and manner and to such persons as he deems fit." ; (b) omitting subsection (4) and inserting in its stead the following subsection:- "(4) The time specified in any notice under subsection (3) of this section for the receipt by the certifying officer of objections shall be as fixed by the certifying officer but shall not be less than one month from the date of the giving of such notice or, where such notice is given more than once, from the date of the first giving of such notice." ; (c) in subsection (5)- (i) omitting paragraph (ii) and inserting in its stead the following paragraph:- "(ii) Having had regard to any objections received by him, and having made such modifications (if any) of the scheme as he deems fit, and having satisfied him.self that the scheme is not contrary to law and is within the objects and purposes of this Act, certify the same; or" ; and (ii) inserting after paragraph (ii) the following paragraph:- "(iii) Submit the scheme to a Judge in accordance with the provisions of section eight of this Act as if the amount or value of the property in the fund in question exceeded six hundred pounds." ; and
14 Charitable Funds Act Amendment Bill of 1962, No. 4 (d) adding to subsection (6) the following proviso:- "Provided that the certifying officer may, in his discretion, instead of giving notice as aforesaid, give such notice in such form and manner and to such persons as he deems fit."
