AN ACT to amend the Charitable Collections Act, 194o,

[Assented to 10th January, 1948.]

BE it enacted by the kmg's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.

This Act may be cited as the Charitable Collections

Act Amendment Act, 1947, and shall be read as one with

the Charitable Collections Act, 1946 (No. 29 of 1946),

hereinafter referred to as the principal Act.

Amendment

of s. 5.

3.

Section five of the principal Act is amended by—

(a) inserting after the definition "charitable pur-

pose" the following words :—

"maladministration" means any act in

moneys or goods collected or held by a war fund or collected or held for any charitable purpose, performed by the persons, society, body or association who or which are or is the trustees or trustee thereof, in con- travention of the duties imposed on them or it by the trusts or in excess of those duties, and any neglect or omission on their or its part to fulfil those duties," and

(b) inserting after the definition "present war" the

following words :—

"securities for money" includes real and personal estate.

4. Section fifteen of the principal Act is amended by— Mont ent

(a)

deleting the words "to whom or to which a license is issued under this Act" in lines one and two of subsection (1) ;

(b) inserting after the word "receives" in line

three of subsection (1) the words "or before

the passing of this Act collected or received";

(c)

deleting the words " (if any) fixed in the license and also at any other time," in line five of subsection (1);

(d)

substituting for the word "statement" in line

seven of subsection (1) the word "account";

(e)

inserting after the word "and" in line eight of subsection (1) the words "a statement of par- ticulars of," and

(1) substituting for the words "to whom or to which licenses are issued under this Act" in lines two and three of subsection (2) the words "referred to in the next preceding subsec- tion."

5. Section sixteen of the principal Act is ,amended as Amendment

of 2.16.

follows:

(a) By deleting from lines four and five of subsec- tion (1) the words "to whom or to which a license is or has been issued under this Act"; and

(b) by adding at the end of paragraph (b) of sub- section (1), after the words "any charitable purpose," the words "and may by the same or any subsequent Proclamation vest and trans- fer the said moneys, securities and goods or any part thereof in and to such persons and for any such charitable purposes as the Governor shall declare."

Amendment

6. Section seventeen of the principal Act is amended

of s. 17.

as follows

(a)

By deleting from lines five and six of subsection (1) the words "to whom or to which a license is or has been issued under this Act"; and

(b)

by deleting the words "and authorise the Minis- ter to apply the said moneys and securities or goods or any part thereof to such charit- able purposes as he may direct" in lines five to eight, both inclusive, of subsection (2), and inserting in lieu thereof the words "and may by the same or any subsequent Proclamation vest the said moneys, securities and goods or any part thereof in such persons and for such charitable purposes as the Governor shall specify.''

Amendment

7. Section twenty-one of the principal Act is amended

of s 21.

by

(a)

deleting the figures one in brackets thus " (1) "

before the word "The" in line one;

(b)

substituting for paragraph (a) the following:—

(a) To prescribe the manner in which and

times when returns, accounts and

statements required under this Act,

shall be made;

substituting for the words "in the hands of any license holder" in paragraph (b), line two, the words "collected or held for charitable purposes."
