Chan & Ors v Macarthur Minerals Ltd

Case

[2020] HCASL 231

CHAN & ORS

v

MACARTHUR MINERALS LTD & ORS

[2020] HCASL 231
B45/2020

  1. The applicants' proposed grounds of appeal do not raise a question of principle that warrants the grant of special leave to appeal from the unanimous decision of the Court of Appeal of the Supreme Court of Queensland (Philippides JA, Henry and Brown JJ) dismissing the applicants' appeal against the decision of the Supreme Court of Queensland (Flanagan J).  Nor would it be in the interests of justice generally or in the particular circumstances of this case to grant special leave.  The applicants require an extension of time but it would be futile to grant the extension sought.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
