The applicant seeks special leave to appeal from the whole of the judgment of the Court of Appeal of the Supreme Court of Western Australia (Mitchell and Vaughan JJA), dismissing as incompetent the cross-appeal of the applicant from a judgment of a single judge of the Supreme Court of Western Australia (Tottle J).
