An Act for the appropriation of certain Un­

claimed Balances to the credit of deceased Prisoners in the Savings Bank. [29th

three shillings and three-pence; being money together with the accrued	WHEREAS there is in the New South Wales Savings Bank a sum of Ten thousand two hundred and forty-nine pounds
interest thereon which lias been deposited by the Government in the said Bank on account of or to the credit of certain prisoners transported from the United Kingdom or from other British Dominions to be repaid to them upon their regaining their liberty And whereas it is not likely that any claims upon the said sums so deposited will be made And whereas it is expedient to provide for the appropriation
thereof to the public uses of the Colony subject to proper provision in
favour of claimants who may thereafter establish their claim thereto
Be it therefore enacted by the Queen's Most Excellent Majesty by and
with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—
1. The Trustees of the Savings Bank of New South Wales shall pay all sums of money deposited in the said Savings Bank by the Government on account of or to the credit of prisoners transported from

from t h e Un i t ed K i n g d o m or from any other Br i t i sh Dominion which are in t h e said bank a t t h e t ime of t he passing of this Ac t together wi th all interest t h a t shall have accrued thereon to t he Colonial Treasurer for t h e purposes of t he Consolidated Revenue of t h e said Colony.

2. I f a t any t ime wi th in six years after t he p a y m e n t of such

money to t he Colonial Treasure r as hereinbefore provided any person to whose credit or on whose account any por t ion of t h e moneys original ly deposited as aforesaid was so deposited or t h e representa t ive of such person shal l m a k e appl icat ion to t h e Colonial Treasure r for p a y m e n t to h i m of t h e a m o u n t of such deposit wi th t h e in teres t accrued the reon such appl ica t ion shall be referred to t h e Inspec tor Genera l or o ther Chief Officer of Police for i nqu i ry the reon and t h e repor t of t h a t officer t oge the r w i t h all proofs i n suppor t of t he claim

shall be submi t t ed to t h e A t t o r n e y Genera l for t h e t ime be ing for

considerat ion A n d if t h e A t t o r n e y Genera l shall advise t h a t t h e claim has been establ ished to his satisfaction t he a m o u n t of such deposit t oge the r w i th all in teres t accrued the reon in t h e Savings B a n k shal l

be for thwi th pa id by t h e Colonial Treasurer to t h e c la imant u n d e r a

w a r r a n t of H i s Excel lency t h e Governor Provided t h a t in considering

any such claim i t shall no t be necessary for t h e A t t o r n e y Genera l t o requi re strict legal proof of all t h e facts necessary to establish t h e claim b u t i t shall be sufficient t h a t such claim is suppor ted by any evidence which t h e A t to rney Genera l shall deem reasonably sufficient.
