MASON CJ: Appointment as one of Her Majesty's Counsel is

traditionally a mark of distinction and eminence in the

practice of the law. These days Law Officers,

Parliamentary Counsel and distinguished academic

lawyers are also appointed Queen's Counsel. But
essentially the appointment remains, as it always

has been, a mark of honour accorded to those in

practice at the Bar who, by reason of their knowledge

of the law and their skill and experience in

conducting cases, have acquired a reputation for

leadership in their profession.

The honour which accompanies the appointment

brings its own responsibilities. One such
responsibility is that owed to the Court. The

Courtsat every level in executing their function of

doing justice between the parties depend very much

on the ability and experience of the counsel who

appear. The quality of judicial decision-making

hinges on the capacity of counsel to define the

issues, to present the evidence and to put the Bench

in possession of the relevant law. And this is

particularly so in this Court where the parties are

for the most part represented by Senior Counsel and

complex questions need to be debated and refined

within a limited time span.

But quite apart from the direct responsibility

to the courts there is the very important obligation

that you as Senior Counsel have to the Bar itself.

There is that continuing duty to pass on to less experienced barristers the benefits of your skill

and experience. The history of the Bar over the

centuries has been a history of constant renewal,

a process which depends on all its members,

particularly its senior members, contributing to
the general pool of knowledge and experience that

the Bar possesses as a corporate institution.

On behalf of all the members of the Court I

congratulate those of you who have today announced

your appointment as Queen's Counsel. I trust that

you will find success and satisfaction in your new

capacity.
